The hate crimes could be very hard to prove. Just standing over somebody using the N word isn't enough. That can easily get thrown out before it gets to a jury if it is contested.
There's three defendants, only one used that term from what I've read in the article you linked. If they are tried together then the other two's defense can argue that including that is prejudicial to their clients.

Biden has already done more for the US and the World than the previous incumbent did in his four years. In fact, if he sat on his hands for four years, he'd be a better president.
