    It mentioned criminal sanctions in delegated legislation so I presumed it was prompting principles and policies....oh christ knows

    Ah stop man, soon as I see a “Long Title” and a government minister, the examiner is getting non -delegation even if he don’t want it!

    I think you’re right with O’Sullivan too in the fishing question - no EU regulation but the facts were so tight (O Donnell - straitjacket point) and then the get out of jail card with fair procedures there and property today. It seemed to fit.

    Is there anywhere I could get something on the consumer insurance contract act in relation to misrepresentation? My manual doesn’t seem to have anything

    I find the marker to be nice and fair. He will give you marks for any correct attempts made. There are people I know who have thought they failed but ended up passing. It is the type of subject that you can argue almost anything that fits. I hope this helps and I have everything crossed for you.

    I think all I gave was a one liner in relation to the cases mentioned and then just talked about standing in a general sense...

    I must say its quite unfair when you know a topic well and the majority of case law ,and then more recent case law are thrown in and that jeopardises that question.

    It feels like the paper is actively trying to catch you out by providing you with an essay option but then it throws in very recent case law that you may not be aware of.

    Similarly, the case note question seemed to be based all on more recent cases... is there an easy way to keep track of recent cases ?

    I am convinced the examiner wanted to catch people out today, like you’d have to all the recent case law which is hard to keep track of and that question on jus terrti was tough I thought, I’d very little on it so couldn’t attempt it. 3 case notes was really to catch people out.

    Thanks for sharing. What approach did you take to learning?
    Did you learn outwards in (ie manuals and such then focus on exam sample answers, if any?) or did you make your way backwards in a sense, ie. by learning sample answers then expanding what you knew in those areas with reading/learning to have a grasp of the principles? I have heard of a lot of people doing the latter and sailing through the FE1s. Of course thats without the legislative changes as you mentioned, which just throws a wrench into it all.

    Contract

    Does anyone know what the name of the case is where the plaintiff was a supplier and the defendant was I believe a supermarket. They never had a written agreement as the defendant had a policy of not entering into contracts with suppliers and the defendant then decided they wanted to get their products from someone else. The court held that since the defendant had such a policy they wouldn't imply a contract.

    I know I have it somewhere in my manual/notes but I've been searching and cannot find it. I really hope someone knows what case I'm talking about lol

    I'd say that I learned outward concentrating mainly on lecture notes and the manuals with some sample answers. I didn't do what many did and write reams of notes but I was a big fan of flashcards with the main topics and cases. You do need to be wary of sample answers though. They're not always the best!

    I approached this question and give similar answer. I think that I only put barlow, so don't worry about it.

    I feel slightly better now thank you! Didn't help myself by completely mismanaging my time.. left myself short of time for this question.. fingers crossed anyway for all of us!

    That's me done for now anyway 6 down and 2 more to go (hopefully) in March! good luck to everyone for the rest of the exams :)

    In EU does anyone know the application of Articles 34-36 TFEU specifically to internal situations? I keep seeing it referenced on the examiner reportsbut its not in the manauls or lectures etc im using.

    do you mean restrictions on imports and exports but not domestic products, or to wholly internal situations?

    Art 36 sets out the exceptions to the prohibitions in Art 34 and 35 which are public policy, security and health.

    If the measure applies to imports and exports but not domestic products it is directly discriminatory and can only be justified under the art 36 exceptions where they are proportionally applied.
    If the measure having equivalent effect applies to import and domestic products but effects imports more than domestic products this is called an indistinctly applicable measure. These can be subject to the Art 36 justifications and objective justifications.

    it came up again in aug 2019. I'm worried that as this is the 4th EU paper this year that anything is liable to come up!!

    Aug 2019? Do you mean 2020, and if so, what question? I don’t have that on my grid!
