I was the exact same! Just answered the essay based on Mohan cos I didn't know the P case so completely ignored it. And I literally wrote a few lines off Roche cos I had no choice but to do it cos the other questions I didn't know at all. I found it such a hard paper. But it seems like a lot of others did too so hopefully he'll take it into consideration.

    Hopefully! :(
I would have been better off to just write the 2 sentences I had on Roche, my PQ answers were actually a disgrace

He'll have fun marking that Constitutional paper anyway.

Hopefully might be a hint to ask somewhat more direct questions :D

I read over it earlier but my own hunch is one question on the independence of the judiciary (so like appointment, immunity from suit, dismissal and pay) and one question on international relations (particular emphasis here on an essay Q on Crotty and Pringle). Of course there is no way to know for certain.

Then I imagine: essay question on disputed result of a referendum; problem question on freedom of expression and company; problem question on freedom of religion and equality. Essay question on one of Pres/AG/constitutional interpretation/natural law. Problem question on trial in due course of law. Essay question on duty to give reasons (fair procedures).

If not the above - perhaps a question on the right to life of the unborn/the right to refuse medical treatment.

    Great paper, very predictable.

There were effectively 3 case note q's on that paper.

If you didn't have an in-depth analysis of each you were immediately restricted to 5 Q'S right off the bat.

I understand the onus is on us to keep up to date with relevant case law, but I mean some of those cases weren't even in the manuals :D

I found it a tricky enough essay question too to try and relate the case law to the question.. went through right to earn a livelihood generally and tried to tie it into property rights/the question as best i could.. also focused on cases like cox, nvh and gs v commissioner garda siochana too like yourself

I thought it was about subordinate legislation.

I threw that in as well just in case but it came up in another question so I though there no way they did it twice in the one paper?

I mentioned the right to earn a livelihood but mentioned there was stronger constitutional protections for property .. also proportionality...did the question not say that property rights were stronger?

I too would be welcome to any predictions

i would also love any predictions
    I'm trying to cover:
    Offer and acceptance
    consideration + promissory estoppel
    exemption clauses
    consumer protections
    misrepresentation
    mistake
    discharge of contracts
    remedies (damages)

Feeling very swamped at the moment as there is so much possibility of what could come up

What are people covering for contract tomorrow? Thinking of leaving out privity and mistake since they were both up in March but not sure if too risky! Maybe terms too

    Hey,
Which question was privity in March?

I'm doing the same, but instead of discharge I'm looking at intention and capacity. All the topics tie in together :(

    Terms
    Misrepresentation
    Remedies
    Consumer protection exemption clauses
    Mistake

    Hopefully that’s enough but haven’t a clue

    yeah it did:
Máire is the owner of the Comfy Café. She decides to expand her café and hires Bob to build a fully completed extension on the existing premises. The contract between Máire and Bob clearly states that the work is to be finished by the 31 January 2020, and it includes a penalty clause which says Bob is to be liable for the loss caused by any delays, howsoever caused.
Bob enters into sub-contract with Charles, a local plumber in town. Charles agrees to carry our all the plumbing work on the extension by 31 December 2019. Bob emphasises that it is essential that his work be done on time. However, by mid-November 2019 it becomes clear that Charles will not be able to complete the work on time. Charles demands €5,000 to enable him to hire extra workers so he can finish the work on time. However, once the work is done Bob writes Charles a letter saying he is not going to pay Charles the extra €5,000. He says he only agreed to the extra money under duress, and that Charles “did nothing extra to earn the cash”. In addition, Máire is unhappy with some of the plumbing work completed by Charles. She claims that water leaks from the pipes and is causing damage to her floors. She is threatening to sue Charles for breach of contract.
    Advise Charles.

Does anyone have any suggestions for recent cases for contract tomorrow? I have O' Mahony v Promontoria DAC [2020] for counter offers, but I know the examiner is looking for up to date law

Possible agency due to sub-contract - Hearn and Matchroom Boxing v Collins
Possible co-lateral contract - Shanklin Pier v Detel (less likely since she never spoke to C herself)
If all else fails she has negligence - Donoghue v Stevenson and Wall v Hegarty

By the sounds of it Constitutional seems the hardest one... I'm not looking forward to that in 2021

Is there anywhere I could get something on the consumer insurance contract act in relation to misrepresentation? My manual doesn’t seem to have anything

TF was going on with that paper! No Family or TDC! I thought The President / AG was red hot too for this sitting! Not even a Referendum Q! You have to play cards with the hand you’re dealt though and I’ve hit the 5/5 so I’d always back myself to hit over 50 in that situation. I reckon I’m home and dry but I’ll leave my celebratory cigar until the results just in case!

I’ve gone for the Gerry Q on the basis of journalist sources with a bit of FoE. (ii) The case note Q - I had a right touch with McGee. Cracking case. Privacy. I also went for Connolly. Duty to give reasons. (iii) The right to livelihood and property rights essay Q although more of an emphasis on the former and then tied the two (iv) NDD and property rights - first I couldn’t decide between property and livelihood but went for property as she treated fishing as a hobby and the price of the license screamed lack of compensation to me. (v) Advising the group Q - went NDD and left it at that. I only had a few minutes left and nothing screamed obvious for Constitutionality of Act part unlike the other one.

Didn’t fancy the other two essays and the last one I reckon was Habeaus Corpus. At first glance, I thought Right to Die but I went “Ah here” and moved on! It wasn’t the best paper we could have got but listen it’s not over until it’s over and we’re all still in the game at this point.
