Resulting trusts is quite a frequent topic and hasn’t came up in the last two years so it’s definitely due an appearance I would think!

It came up in March twice actually.

Q4 - Presumed resulting trust PQ - Joint account

Q7 - Note on distribution of surplus funds upon dissolution of an unincorporated association.

    Hey everybody doing Contract,

Does anyone have an up-to-date grid, exam papers and exam reports for Contract that I could beg for? The last time mine were up-to-date, Obama was in office!

Although they were helpful to a point, they're not very helpful beyond this point and particularly preparing for what comes up on Thursday. Would be forever grateful if anyone could help me out and can swap basically anything anyone needs :)

Hi :) I can forward this on if you want to pop me a private message with your email

Could someone please clarify whether campus oil principles also apply to quia timet injunctions? My understanding is that they do apply with the additional proof required of actual and real danger - is this correct?

    Yes that’s correct

    Equity

Are people mentioning the 8 part test in Merck Sharpe & Dohme for interlocutory injunctions? It is included in some of my notes, and then in additional notes there is no mention of it. Thank you in advance!

Hi all, sorry if this has been asked already. Been mad busy and haven’t been able to source a copy through the mygov site. Are you able to just print out a copy of the sale and supply Act online and use that? Cheers

    Contract
Hi does anyone have the March 2020 contract paper, or even what topics came up? I think someone before said statute of frauds did, are people leaving this out?

    Constitutional

I was thinking of covering the following, does anybody have anything to add or leave out?

    Family & Education
    Freedom of Expression with liberty/assosication
Property rights with inviolability of the dwelling
    Equality
    Personal rights
    Limiting and Balacning Rights
    Due Course
    Executive SOP with International relations
    President AG
    Locus Standi

Im wondering the same!! would this be enough to get 3/4 good questions out of??

Looks good. Would maybe try and include interpretation if you can. It's usually one of president/AG/interpretation that comes up and they seem to be due a run.

No they’ve said we can’t use print outs - same as normal exam times. We can only use the OPW ones or any other official publication

Looks like I might be sunk. Does anybody have a copy of the sale of goods Act they are willing to sell in the Dublin area? Can pick up wherever!

In terms of mandatory relief, is it the same course of action for eg the plaintiff must establish the higher standard first by demonstrating they have 'a strong case likely to succeed at trial' and if established then you apply the Campus Oil test thus after. If the plaintiff does not establish the higher standard of a strong case then they will fail the first limb of the Campus Oil test of 'is there a serious issue to be tried' and subsequently the relief for mandatory will be denied.

    Hi all,

What area of charitable trusts came up in March?

I’m not sure that’s still the case for these exams. I read on here or somewhere else say that they rang the LS and they confirmed print outs were okay. At any rate, they haven’t asked us to even show the legislation during the exam, so they can’t even know what type of copy is being used. I would say print out is fine

Am I correct in saying the injunction Q on the equity paper is usually 2 injunctions in an a or b type style. And you do one? As in you can’t answer 2 questions on an injunction

Yea I’m just going by what they said in the guidance - maybe best to email them and confirm

Is there any recent cases for contract law that I should be aware of for the exam? The notes I have are quite old and wouldn’t have any recent cases.

You'd need to ask the Law Society directly, it would be too risky to use a print out without confirmation from them imo... then if you're accused of reading something that's not a permitted source it would be too late after the fact

    EQUITY

For Estoppel, is there a need to cover Imperfect Gifts, Common Expectation and Unilateral Mistake or should Unconscionability suffice?

I mean it would be up to them to prove it’s not a permitted source which would be impossible unless you held up the printout to the camera

Honestly, just print it out. There's zero checks in the exam itself and you could be reading The Great Gatsby to clear your head for all they know. Thankfully, I got the official legislation but if you don't want to, you really don't have to for this sitting.

Just wondering if anyone else who sat Company was confused by the incorporation question, it asked to advise on (a) advantages and disadvantages of incorporation and (b) consequences of incorporation ...but didn't clarify whether it was a two part question for equal marks or else just indicating topics to be discussed.

It really confused me during the exam as I then felt I needed to separate them out, but definitely gave more weight in my answer to adv/disadv. Usually they would state it was separated for equal marks, but putting in the (a) (b) was really misleading then if it wasn't. I've emailed the LS about it but curious if anyone else thought the same.

Well it would be impossible for you to prove that what you were looking at was a permitted source, if what you were looking at was not a permitted source...

Haha I’m not arguing with you I’m just saying it’s impossible to prove either way - otherwise everyone is somehow going to have to prove that what they were looking at was in fact the permitted legislation
