    Paula sheedy just replied to my email about 30minutes ago saying they were available and sent me my result but they are also on the website. Sadly wasnt brought up for Tort though which is disappointing! Whats everyone studying for tort i have left it until now as i was sure i was going to be brought up :(

    Would anyone have any criminal law sample answers ? Or even any advise on structure for answering questions! I’ve EU, tort, equity and property sample answers I can swap for!

    Does anyone have condensed, easy to follow notes on directors' duties.. I went by sample answer and manual - however the city colleges NB notes have more cases that I don't have, and manual refers to a lot of irrelevant cases. My head is all over the place now. Can swap for sample answers.

    Can we highlight relevant provisions in our legislation? I know we can have it marked but does that include actually highlighting it does anyone know?

    pretty sure highlighting is permitted yeah, i had mine highlighted in the exams anyway - just no writing obviously

    Hi for Constitutional I have broken my study up like this:

    - I am just wondering is this enough like if I have covered all of the below should I be alright?

    Potential Essay Q's

    - President
    - AG
    - SOP - general question of it all
    - DPP v JC ("This case risks reducing level of protection for constitutional rights in Ireland" - unconstitutionally obtained evidence)
    - Since Mallak v Min. for Justice, less onus on decision makers to give reasons for their answers - DIscuss
    - Const. law on Equality has failed to reflect its importance as a value in irish law.

    Potential PQ's

    - SOP (particularly Executive/International Agreements/Principles and Policies test)
    - Courts (particularly Special CC)
    - Right to silence, Privilege (to not be cross examined) thus Unfair Trial
    - Equality, justified discrimination
    - Bodily integrity, Right to Life, Right to Privacy, Right to earn a livelihood
    - Property rights
    - Due course of law
    - Religion
    - Right to Expression, Assembly, Communication
    - Family (de-facto family rights)
    - Proportionality
    - Vague Offences
    - Locus Standi (Jus Tertii)

    Looks like a pretty solid list to me. Religion/Locus Standi can often come up as an essay question also - just a heads up! Would look at sovereignty also if you can.

    They also didn't answer that part of my disability query - but I think now that everyone has 3.5 hours it will probably be the same for everyone

    Here's what I have from 2018 studying.........


    Interlocutory mandatory injunctions
    • Most Irish judges have been reluctant to depart from the Campus Oil principles; however some have suggested that mandatory interlocutory mandatory injunctions require a higher degree of prejudice….
    • There’s uncertainty in Ireland as to the applicable test regarding the granting of interlocutory mandatory injunctions.
    • Regardless of whether….. it will still rarely lead to the granting of a mandatory interlocking injunction because it’s only in exceptional circs will the balance of convenience lie in the favour of granting a MII.
    • Risk of injustice approach developed from the Films Rover case; this was a more flexible approach advocates taking whichever course takes the lowest risk of injustice. If we bear this in mind and we grant it or don’t grant it and should’ve done otherwise, then there will be a low injustice.
    • In conclusion, there’s a movement towards the strong case approach in this jurisdiction in applications for MII but the addition of the ‘lowest risk of injustice’ from the Tola Capital Mgmt case would act to guard against cases where there isn’t a strong case and yet prevents an injustice to occur between the parties.
    • If Q about MII, tease out differences between Campus Oil and the strong case approach.
