I'm just going to read it over to have it to include on a question on directors but it doesn't come up as often as duties or restrictions

I keep trying to order them and the page just says "under maintenance" everytime I go to pay. I don't know why this is.

Would anyone have a Company sample answer on the essay about Foss v Harbottle still being useful alongside Minority Oppression?

I have March 2020 papers to swap or other material for Property, Company and Constitutional.

    Thanks

I called up this morning and got through to a woman named Carmel. Her words to me were that she was told the same, they'd be out early this week, she thought that they should be out by now.

She took my number to give me a call back once she found out more for me, but still nothing back now and that was about 5 hours ago.

Just got thru to Shirley she said they’re working on them as we speak and should be out very soon (didn’t say it would be today )

Can we highlight relevant provisions in our legislation? I know we can have it marked but does that include actually highlighting it does anyone know?

For Criminal do you need to know all of the sections for the public order offences.... Is there any way to narrow it down? 🥴

    Yeah, I have that too.

I wonder if this is for the people who couldn't do it before or if this is another dry run for all of us

Seems to be that way but schemed through mutual mistake anyway just in case

Yes they appear more frequently than mutual. There's been problem questions where you could argue it s either as it doesn't confirm if one of the parties actually knew about the mistake. Theyv noted in the examiners report that a discussion as to which doctrine applies would be wothwhile in that instance.

Could anyone share what topics they’ve decided on for company?

  • Registered Users, Registered Users 2 Posts: 208 ✭✭Aoibhin511

Does anyone know if acknowledgment of title in relation to adverse possession has to be explicit? Or does replying to a solicitor's letter telling you to get off, or telling the person you sell the land to that the paper owner hasn't been in years amount to acknowledgment?

  • Registered Users, Registered Users 2 Posts: 12 JudeLawX

Based on suggestions on this forum I've narrowed it down to :
    - SLP
    - Directors (duties etc )
    - Restriction
    - Shares/ Share Transfer
    - Shareholders Protection (S.212 and Floss v Harbottle)
    - Corporate Borrowing (Charges and ROT Clauses)
    - Winding up

I'm hoping to know them inside out by this time next week. Then I'll have an understanding of the Doctrine of UV, Examinership and Realisation of Corporate Assets incase I get really stuck but idk how realistic it is that I'll manage to know them at this stage. These are the most common topics people seem to be studying for this sitting, not great logic to base it off but there's not much pattern when it comes to company papers. Hope that's helpful.

From what I can remember, those "squatting" on the land must have physical control of the land and show intention that they intend to possess it with the exclusion of others. This intention can be shown by going to your solicitor and getting an affidavit stating that you/your predecessors have been in possession of the land for at least 12 years (or in cases where that State is involved, 30 years) so I think it has to be explicit
