    constitutional law - SOP
    Hey I was wondering if I could get someones opinion please! If a general essay on the SOP came up for constitutional for example like the one in march 2018 Q 5, is it ok to talk about the SOP generally in your introduction and then just focus on one area for example non justiciability or the non delegation doctrine? or do you think the question is looking for a more general discussion on SOP that involves pretty much everything?

    Just looking at Courtney's reports on this and he seems to want us to list out all the relevant sections (section 175-195), except a few.

    What are people's thoughts on doing it like this....?
    - S182 requires a quorum of 2
    - S183-184 sets out the governence measures in relation to proxies
    - S188 concerns voting powers


    Obviously, for some of the sections which are more specific to the EQ asked, you'd be delving into more detail. And the emphasis of the EQ has been on the 3 mechanisms by which members give their sanction (resolution at a meeting, written resolution, and thirdly via estoppel/Buchanon aka Duomatic principle). I think writing it all down is irrelevant only he's asked for it. But don't think we'd have time to delve into it in an EQ.

    currently struggling with this too but I ended up talking about how consideration operates on the premise that there's a promise between the parties and promissory estoppel seeks to prevent a party from going back on that promise, pre-existing contractual relationship (because promissory estoppel cannot exist independently), a couple of cases for it, then on to part payment (Pinnel's case) and acts of forbearance because parties to this may be estopped from going back on their promise and cases on this again

    not much of a structure to be honest but that's what I have so far

    There are often so many issues to cover!

    If anyone has any tips about how to go about this, would greatly appreciate it!

    Yes and now that we’ve to type it I’ve to figure out how much is enough. I know we have the clock to check our timing but at least before when we wrote the answers we knew the number of pages that was a good answer!

    yes omg I posted about this a few posts ago, its a bit insane how many issues are covered per question. I have decided with the online format what I will do is write the issues, then for the law just state the statute and case law for each issue (in bullet point format) then do the application and conclusion and then come back at the end if I have time to talk about details of cases or anything else.
    I think the main things that the examiner is looking for is, can you spot all the relevant issues, do you know the Act and any case law that is relevant to the facts of the question. I see that it is remarked on the examiners report that giving advice is part of the question and should be done, so I am actually going to do the issues and conclusion first, get them out of the way and then do law and application...but that's just the method I have found the easiest since I have started typing!

    I passed criminal in the last sitting, and it does seem like there are so many issues per question but he's not expecting a huge amount of info on each issue.
    I think the best approach is to just write a small amount on each issue. Really just mentioning the key cases/statutes. That also means you don't need to be studying every single case on each topic, so it should help you to cut down your study notes. I tried to study every topic for criminal, but just in very basic detail. Realistically as there are so many issues in each question you may only find yourself writing a couple of paragraphs on any given topic so there's no point in learning pages and pages of notes - just the absolute key cases, maybe a recent case, the statutes, and if there's an LRC report that can be good to throw into your conclusion.

    In one or two of the questions I answered I didn't address all of the issues in the question and then in hindsight after the exam they seemed like such obvious and important issues to address, but I still passed even without discussing them. That's not to say that you'll be able to just pick out one or two issues per question and ignore the rest and expect to pass, but there is definitely some leniency there.
    The examiner is a really nice marker and will give you marks wherever he can so just try to make sure you're naming the key cases and relevant statutes and you'll get marks for them. I also found for criminal you don't need the facts of the cases, just what they decided.

    Thanks so much for this! Has relieved the stress a lot.

    And glad to see I'm not alone in this.

    I am finding it weirder practising my answers when they are typed in general. It's easier just to move on with handwritten answers, where as when I type I keep going back to edit previous points!

If anyone has any suggestions or would like to share what they're covering I would be so grateful - I am doing 4 subjects and running out of time to cover things.

    Hi All

    I am wondering if anyone can advise when it comes to problem questions in Criminal specifically the murder/manslaughter questions would the following be and okay way to answer.

    List the issues (criminal liabilities)
    Explain what actus reus/mens reas are
    Explain murder and manslaughter
    Explain the defences (specifically the ones the questions reference eg intoxication or insanity)
    Apply the law to the case.
    Conclude

    Just finding this difficult as I can't get as much onto the page typing. How much detail of actus/mens is okay? This is the area I think I'm writing too much and its throwing off my timings.

    Any feedback would be welcome ðŸ™

    Hi,

    Was just wondering if anyone had any advice on how to approach problem questions in Constitutional. I am not a law student and really struggling with the work load and can't seem to identify problems a lot of the time.

    Also wondering if any lovely people might have the 2020 Constitutinoal exam or any exam question samples? Asking a lot, I know, panic is starting to kick in!

    Hey guys,
    just a point of clarification. From what i can gather from this thread:
    We cannot use rough paper to draft/plan,
    We cannot go to the bathroom during the exam,
    We will not have to give a walk around of the room before the exam but our eye movements will be monitored by proctorio software,
    invigilation will be automated,
    We get an extra half hour,
    i have done the mock and the system seems grand - bit of a nightmare not having a place to scribble rough work but it's better than waiting in purgatory like we had been0. i know how poor the Law Society have been over the last couple of months so i figured it was best to clear is up here - i've gone through a fair bit of the thread and couldn't find answers to everything.
    i hope someone can help and that everyone is well!
