    If i realise i can't answer 5 questions after learning 15 topics for tort, i'm going to flip the table over an walk out after 5 mins :)

    Kind of left it a bit late but trying to put an essay plan together for limitations as i haven't looked at it in weeks and note one or two predictions on here...

    I have a general understanding of the topic and the different categories but could anyone tell me what Key cases and info you would need for an essay? Cheers!

    you'll have to twiddle your thumbs for 25 mins first though. Can't leave in the first half hour I think?

    I'll have to stay until my lift comes back so no table flipping for me, but I know how you feel lol

    Statute of Limitations Act and the changes made by s7 Civil Liability act and s38 of defamation Act.

    Trespass to person action for battery issue 11(2)(a) or 11 (2) (b), Devlin v Roche
    .
    Concept of time running Hegarty v O'Loughran and the legislative response in SoL Amendment Act.

    Problem of undiscovered injuries Section 2 SoL Amendments act: Gough v Neary, Cunningham v Neary, Dealhunty, Hardiman v Green, Attribution.

    Identifying the defendant issues Boylan v Motor distributos, Fortune v McLoughlin,

    Plaintiff with disability s48 and 49.

    Undiscovered property damage, pure economic loss and the impact for Pyrite, do we need legislative change.

    LRC proposed reforms.

    I have nothing else so if anyone spots anything that should be there, chime in please.

    Its the first whole hour this time according to the letter, I think it's because theyre staggering start times and won't let the 9:30s out before the 10:30s are all in their seats

    They changed the location(s) this time so I don't know what their plan is, but they've always had a cloakroom of some sort (in Dublin, idk about Cork)

    I don't think they can allow that given the whole situation with the virus. They have a list sent out to everyone of what you can bring and there's no mention of a bag. I'm leaving my bag in the hotel and bringing pens, tippex, a ruler and masks with me and nothing else.

    When they were in the Red Cow I used to just leave my bag outside the exam hall up against a wall, most people did the same. Doubt they will be allowing that this time around though

    How do I know when to use VL or employers liability?

    Vicarious Liability is used where the employee causes an injury to third parties

    Employers Liability is to do with the duties an employer owes to his employees

    It is usually released right after March sitting but they’re not releasing it this time until after August sittings

    How do I know when to use VL or employers liability?

    employers liability arises when the employer is directly at fault for something ie not providing a safe system of work/safe place of work which results in damage/injury to employee.

    Vicarious liability the employer is not directly at fault for anything - you are seeking to have them held liable for fault of another. A good indicator is to look at who you're being asked to advise. So for eg if the question is about an employee being negligent and causing an injury to your client but you're asked to advise your client of the employers liability it will be vicarious liability.

    Quick question... I ordered exam papers and still waiting for them to arrive.How are Member State Liability questions asked? What do i look out for??

    Does anyone have the questions from the last Tort paper (Autumn 2019?) I have all the others just not that one.

    Let me know if you need any of the others yourselves (back to 2011)

    I can see it come up on my grid quite often but nothing is mentioned in my manual! :/

    I've not come across that either. Do you mean like concurrent tortfeasors or just claimant (the person suing), and tortfeasor, (the person taking the action and the person being sued, accused of liability?)

    Can you give us anymore context? Don't name the manual, school grid or anything, just a bit more about what it says?

    See I’m not sure where my grid comes from, just got emailed it from someone on here - topics don’t exactly coincide with my manual!

    Grid just says ‘parties to a tort action’
    If it’s any help it says it came up as q6 in October 2019!

    Tort is just so so huge! I’ve never learnt 15 topics for any of my previous exams and am so nervous I could have focused on the wrong ones, or the wrong sections and still be left totally stuck on the day! :/

    Almost always in a problem q with direct effect. So directive/regulation isn't transpose properly/on time. John suffers a loss because of this. Advise John. First you have to figure out whether or not John can benefit from direct effect and if so then you discuss MS liability
