    It could be very interesting. I presume, for reputation etc., Deloitte will have to fully defend it. I don't think any of us would suggest they did anything other than what they were instructed to do and acted on the basis of the information they were given, so it might shed more light on the workings of the FAI.

    How does he get to decide what falls under legal privilege?

    Would it not be the case that the prosecution sift through the evidence, pick out what they want and then JD and his lawyers try to claim legal privilege?

    I can just see JD waving his hand over a whole bunch of files and mumbling 'legal privilege' before then tying up the courts with more legal wrangling while the prosecution try to get hold of them. I don't understand how that can be allowed.

    Would it not be the case that the prosecution sift through the evidence, pick out what they want and then JD and his lawyers try to claim legal privilege?.

    Privilege is claimed before discovery/disclosure.

    You say what documents or category of documents are not being disclosed and why not, what privilege is being claimed. This can then be reviewed or challenged. You don't hand over a document and then assert privilege, the information is disclosed by then.

    Ultimately it's all subject to review by the Courts. But, where it arises, Discovery is a very important part of litigation and it can take a very long time to tease through, it can takes months, it can take over a year. Because it can be the winning and losing of a case, an email here that contradicts what a party is asserting in Pleadings, an account there that wasn't disclosed in, say family law proceedings, and suddenly a case can turn on its head. Sometimes a party's position will be completely undermined by what they produce, so they should go through each and every email, account, document, line by line.

    If someone is found to be hiding documents wrongly asserting privilege, they can be penalised in costs.

    Im sure his solicitors are working thoroughly and with complete moral integrity. & poor John has to pay the bills and provide for his family that he left behind.

    Anyone know if this Office of the Director of Corporate Enforcement investigation is conducted in a court?
    Or is it just the Court's deciding on what the "corporate watchdog's investigative powers" can and cant use?

    In fairness, I would assume they are too.

They know the consequences of participating in any attempt to hide or bury documents, and how fickle clients can be ("Judge, I wanted to show it but my Solicitor said I should hide it").

    Of course. & his senior counsel, former chairman of the bar, specialises in defending professional negligence claims and ensuring his defendants are "properly notified of the demand or given an opportunity to contest it. (v's revenue commissioners)"
