    I was confused about this as well but I think I figured it out. Fair Procedure seems to be interchangeable with Natural Justice so it might be down as that.

    In the Independent Manual it's the last section in Personal Rights.

    Anyone who sat the October '19 Constitutional paper and passed Question 1 (Re: Diesel Fuels Ltd), could you please explain the topics it considered? I answered it including the issue of the Agency having the same protections as the Oireachtas per Kerins (2019), then questioned was it acting ultra vires its powers using the non-delegation doctrine, the issue of s.8 being a criminal offence encroaching on judicial territory and distinguishing executive and judicial powers per McCrystal and when court will intervene in extreme circumstances. Then considered right to a good name for the "name and shame". Then considered due process Art.38.1 as the Agency initiated criminal prosecution and said it breached SOP. And ended with considering whether or not it was a criminal matter per Mathghamhna and if it was its for the courts and not the agency so said Diesel Fuels would likely be successful because of that. I failed the question miserably and still don't understand what I should have mentioned. Any help would be much much appreciated.

    Criminal Law question

    With the defence of intoxication, from my understanding it cannot be used as a defence for crimes of 'basic intent' ie those crimes where the mens rea requirement will be satisfied by proving recklessness.

    My confusion arises because as I understand it the law in Ireland on recklessness is that it is a subjective test, ie the accused must have foreseen the risk but carried on regardless.

    Can anyone explain why intoxication cannot be used to establish the accused was not subjectively reckless? I understand why intixication would not be a defence to objective recklessness, but the subjective element is confusing me.

    I am currently doing constitution for the first time. My understanding of the question is its just the delegation of legislation and the principle and policy test set out in Pigs Marketing, Cityview Press v Anco, Harvey v Min for Social Welfare, McDaid and some of the more recent cases John Fried Chicken and Bederev. McKerins is only relevent to internal matters of the Oireachtas in relation to privilege and McCrystal relates to referenda.

    Just got the email from the Law Society about carrying forward passes from before the rules changed for this sitting. If they’ve accepted some already as I’ve read they have, you’d wonder on what basis they can then refuse applications?

    I haven't heard of anyone who was refused once they applied for the exemption. Maybe someone else could confirm if they had a request to carry over refused. I have not heard of one yet. I know people who carried just one pass, and some who have carried from March 2018 sitting.

    Yeah I think they might just be trying to make it sound less of a formality, fingers crossed anyway - I wasn’t going to bother trying until they emailed

    Wouldn’t panic to be honest. I know people who have applied over 2 weeks late and got sorted. Just get in touch with the Law Society and they’ll get you in.

    On my (HOPEFULLY) last sitting and worried about topics for Constitutional as I really need to pass this round. Would I be save with;

    SOP, Interpretation, property rights, equality, family, JR + Unconstitutionally, amending Constitution, freedom of expression/assembly/expression, President/AG.

    Obviously you can never be certain but is this along the lines of what people are covering?

    I only answered succession (very well) 2qs on it, adverse possession, easements and co ownership, plus had learned finding and licenses and family home, easiest exam I have done, succession is nearly guaranteed 2 questions and adverse possession is another guaranteed so you have 3 questions basically going in.
