Yup. Attitude and professionalism is of more consequence.

Trainers and freelancers mean nothing to a company. NOTHING.

    Employees mean a lot more.

HR can't really takes sides between a dispute between two employees at first unless there is a severe issue. But they don't give a **** about an outside trainer.

We don't know whether the others got an email on Sunday. If they did, the OP has no basis to complain about that. The other stuff about attitude is just what we get from his side.

They paid him. Doesn't matter, He sent the email, it was wrong an he also never stated negitive marking so you can't just throw that in.

Bottom line, if he runs this process it must be clear and he must take a more professional approach in the delivery of the results.

Anyone who doesn't see that isn't looking properly.

Did hr design the test though? That sometimes happens too. :/

    HR metrics :/

The day in question is irrelevant.

Everyone i know sends work emails on the weekends sometimes.

It's the attitude in the email and on the course itself.

OP i would ask what your co workers thought of him.

Also of course he is corresponding with your employer through the HR dept if they paid for the course. He would have to.

It doesn't matter. The email is ...

    Hi (name)

We had X attendees on the course on **/**/** and Y(one less) made the PASS level, unfortunately (name) , you did not reach the **% pass rate. I personally checked this paper and could not change the result.

    Many thanks for your participation.

    Regards,

That really got on my nerves,

There's nothing wrong with that email and there's no mention of negative marking, either

You think that email is fine? Well that is where we differ. There was no need to run with that opening line unless you are looking to antagonise and on a sunday afternoon.

The negative marking is something he mentioned after.

My dad would challenge the result of any test he failed. I only found this out when he was doing a psychology degree as an adult and i was a bit older so he would talk to me about it.

I always thought you had to accept the result you were given. Naively.

I never knew it was a jumping off point. To him it always was. I was amazed you could do that.

Needless to say i only have a B.A my dad has two bachelors and phd and has worked at the top of business in several industries. And you never would have though he would get that far from where he started believe me.

    You have to fight.

Your dad is right. I find my current job traps my natural personality to openly challange which i am starting to feel suffocated by.

For sure that should have been mentioned prior to the test as should the fact that a test would be taking place have been mentioned prior to the course.

I still think that's a fairly bog standard email, though.

I can't see how a 40 question multiple choice paper, marked using Negative Marking could produce anything except a definite result for every participant. Regardless of any challenge that result would stand.

To be honest I am not interested in the result or the course. I am interested in the fact this guy dared email me that on a sunday. He had to know that email was going to annoy and therefore sent it.

If it turns out that you were the only one who got the email, then he was singling you out. But we don't know that. Your assumption that it was done to annoy you is coloured in my opinion by your attitude to him.

He's an eejit and an extremely dislikable one.

And if he sent an email to all it will be interesting to see what the opening line was. Does he mention the course attendees and the one who failed, I will find out.

I personally thought the choice of words in the email was disgracful and if an employee of mine did that on a sunday then they would be in a spot of bother to say the least.

But if it turns out that the Fail was correct, would the fact that the trainer relayed that to him by email on Sunday be a matter of any consequence?
    None at all.

Being on a Sunday makes no difference.

The only issues here, are not actually ones you brought up.
Firstly, why are your company sending you on courses with no recognised quality framework, this is insane. A lecture series or meeting, fine, but paying for a course with an exam that if it was relevant in the future would never hold up in court, is insanely naive of both your employer and you, but more them.

Secondly, the email doesn't cross any legal boundaries and the fact it came on a Sunday is irrelevant. The issue is the pass rate of the class. It should either be a link to an online record or a some statement of pass/fail or result. It's not wrong but it is stupid, whether everyone passed or failed is irrelevant to the OPs result, the same goes for any exam.

The only thing to take from this, is not to be annoyed with the course runner but your company for being so inept as to sign you up. Send them a mail, let them know he is not providing legally recognised certs, is not organised and is not professional, you would recommend that they use an accredited supplier for such training in future if they want to certify employees.

The only way to settle this is to challenge your nemesis to a steel cage match. **** being nice about things.

Edit: wrestling match, in case it wasn't clear

And if he has no fingers, play Rock.
    You can't lose!
