equity. 3 ok to good answers, 2 really really awful (specperf was general gibberish and only a page and a half, and I made the 'aisling painted them' mistake)... how ****ed am I? is there any chance they'll pass?

There's always a chance if you attempt 5 Qs. Since reading this I'm not sure how many can be picked up from the injunction Q tho. I don't even know what a QT close is. I cut that out assuming MI Mavera or APO would come up. Ahhh, move on is the only logical thing to do.

I’m completing confused by people saying they answered question 8 in equity wrong (ashling and injunction)

What would have been the correct way to approach it?

What I did was go over the difference between a prohibitory and mandatory interlocutory injunction, talk about the higher standard for a MII, then say it's hard to tell whether she'd get one bc the facts and law are so unclear but that it was more likely that she wouldn't because she hadn't paid for them on time so that might mean she doesn't have a strong enough chance of success for the Lingham v HSE test. I think other people got confused and thought Ashling painted the paintings herself or something? Not sure.

Depends what you consider ok to good and how you answered them! If you feel like you used all the relevant case law and came to the correct conclusion, you might be ok!

Quistclose Trusts.... question was similar to Harlequin Properties v O Halloran

That must have been the least answered topic on the paper by far. It would have been nice if you knew it though.

I was really thrown off by this paper. had 5, probably had some relevant stuff in the bad ones. ill cry about it after contract tomorrow.

they where solid enough, plenty of relevant cases, applications were mostly thorough, essay on trustees duties had a relevant conclusion. think maybe it is was only one messed up i'd have a chance.

does anyone have any insight into how they mark them? I'm assuming each is out or 10 or 20, and they have a list of what they expect to see and tick it off...

I was happy enough with the Equity paper. In hindsight I wished I answered the question on the Mandatory Injunction as opposed to question 3 (Rule in Hastings-Bass and Strong v Bird) because I had only one case as an example for the rule in Hastings-Bass. Hoping I did enough to pass.

    Hey everyone,

Hope everyone is happy so far with how it’s going? I’m finished think I got the magic 3 but know I didn’t get equity.

I sat tort, property and criminal.

What would people recommend sitting with my repeat equity in March? Was going to sit 2-3 exams as the 4 this time almost sent me loopy!!! :)

Really hope everyone is doing ok...stressful times for us all!

My magic 3 is all riding on Contract tomorrow, the fear!

As for your question, I believe people say there is some overlap between equity and contract.

    Contract*

Any thoughts on capacity / minors making an appearance?

Have covered all the below lightly
    Misrep
    Discharge
    O/A
    Consideration
    Mistake
    Capacity
    Breach
    Remedies

    Am I being naive?

Also I hope everybody is nearly seeing the end of the tunnel at this stage :)

Night before notes gave it a nod so I wouldn't be surprised, although generally an unpopular topic. You may want to breeze over consumer protection before spending any more time there though.

Speaking of which, does the 2011 Directive do away with the need to prepare the Negotiated away from business premises regs and the contracts made by distance selling regs, does anybody know? Wouldn't seem to have a bearing on the Unfair contract terms ones.

Is Hadley v Baxendale an “and” or an “or” test?

Best of luck in your contract exam. That was me for criminal two days ago. I have everything crossed for you!

    OR

First limb is natural loss arising from breach OR

Special damages may be awarded where the party was aware of a special harm should the breach occur. The second limb requires specialist knowledge.

What’s more important to learn for EU - citizenship or equality? Not sure what to do. Also can I leave out institutions as it came up last sitting.

Pretty sure equity didn't go my way today and have EU Thursday and am essentially starting from scratch. Any advise on how to cram the whole course by 9.30 Thursday?

Exhaustion levels have hit a whole new level so keeping the tears at bay is also proving difficult.

Keep it together - you’ve done your best so far, that’s all you can do, you never know with equity, don’t write it off. Take a deep breath, go for a walk and then come back with a clear head and focus on EU. You have plenty of time.

If you’re starting from scratch, I would say it’s probably time to roll the dice. Pick 6/7 topics. Learn them inside out. 4 hour sleep cycles and hope for the best. I think it’s near impossible to learn a whole course in 3 days.

    EU

Considering Fundamental Rights came up last sitting, I assume if Gen Principles are coming up again it will be in a question concerning an overview of all of the Gen Principles... any advice on how to approach this kind of question considering Fundamental Rights takes up such a substantial portion?

  • Registered Users Posts: 3,891 ✭✭✭iamanengine

Would I be mad to leave out Misrep?

    Surely it's due a gap

Can be clever about this. If you have equality learned off - that’s a paragraph sorted. Proportionality - every FMOG case ever.

In terms of timing, get down the cases for fundamental I wouldn’t cut any - but much less detail than if a standalone essay.

    Just my opinion :)

That'll be a rough one to do, but not absolutely impossible if you have a basis on the topic.

If you're really cutting topics it'd be worth looking at the Night before Notes & also have a gander at the video under EU Law - https://citycolleges.ie/fe1-night-before-notes-october-2019/

Yer man is really to the point and runs through how the questions should be answered under a few different topics, should they come up in certain ways.

    Best of luck!

I think Q2 was constructive trusts, but I'd say we need to blend the case law and answer it.
