You need to get a green card first and then get citizenship after that; three years later, if I remember correctly. This chap did neither. Never bothered applying for a green card in the first place. Stayed there illegally on his three month holiday visa since 2007.

So if you go about it correctly an Irish person can marry an American and settle there if they wished?

I am no US immigration specialist, but what I would think is that once you break some immigration laws (entering or remaining illegally), you are forfeiting your entitlement for most legal immigration routes.

No, they review it on a case by case basis and immigration services will decided whether or not you are up to the standards that are required to gain citizenship. Given the nature of the crimes committed by this guy, coupled with the fact that he's been working on a consistent basis, I think he may have accepted.

i.e. all other things being equal an applicant with no history of breaking immigration laws would be see more favourably than someone who was caught overstating their visa/waiver.

It's not a competition. Each case is reviewed and if the crime is not serious and they've been working hard and contributing to society they'll gain citizenship.

So. If he didn’t or marked no on any document that was used for a visa status change for the US and as is normal in the back ground check then it’s seen as he lied . That’s a refusal right there.

It is a criminal offence to provide false information for the purposes of obtaining a visa waiver or visa to the US.

Seems he didn't care about the law in Ireland or the US.

He's screwed. The only thing that can save him is if they make an exception. Sadly the fact he's applied numerous times and been refused doesn't help, it just means he didn't slip through the cracks, they know all about him and still want him gone.

I'm confused. This man entered the US on a three month tourist visa in the early 00s and stayed there. There were no subsequent visa applications. If a person lies on a visa application in the US, you'll get rejected. Ditto for every other country in the world, I'd imagine.

This is the first time I've heard anyone use it, but no matter - it's ignorant, and the liberal who used it is ignorant.

I've compared the phrases "all liberals are...." to "all conservatives are..." with various endings to highlight the ignorance of said terminology, no matter what group is being labeled or who is doing the labeling.

It's simply used as a means to hide the fact that the person using it - be they liberal, conservative or whatever - is not actually making any relevant point to the debate in question, they're just opportunists hurling insults.

I've nothing against conservatives (or liberals) - I've some conservative (and liberal) viewpoints of my own - as long as they can debate intelligently and respectfully.

End of debate. We're supposed to be talking about an Irish guy who overstayed his welcome and got deported.

He apparently entered under the Visa Waiver scheme. You can only do this if you have no convictions. If you have a conviction you have to go to the US embassy and apply for a visa, depending on the severity of the crime etc you may be given a visa. He seems to have lied so that he could travel under the visa waiver scheme.

Sure it doesn't. You can't just buy citizenship there are going to be a lot of other conditions probably including not having being convicted of a crime.
