    [font=Georgia, serif]Paul McArdle, Medebawn, Avenue Road, Dundalk, Co Louth, has brought a High Court action over the post which appeared on November 9, 2014, but was taken down by the next day.

    Facebook denies he has been defamed and pleads EU e-commerce rules provide it with immunity from defamation suits once a post is taken down expeditiously.

    It says it is not a publisher but merely a facilitator of material.
    It has in the past provided information on the identity of posters who have been personally sued. However Facebook itself has not so far been sued in Ireland for defamation, it says.

    It also says Mr McArdle (36), an unemployed welder, has seven previous convictions, including one for possession of drugs dating back many years ago and another for assault.   This was information provided by gardai following a personal data request, the court heard.

    Mr McArdle's lawyers obtained orders that Facebook provide disclosure of certain information in advance of his legal proceedings, including in relation to how many people viewed the post before it was taken down.

    Facebook was granted its application that Mr McArdle reply within six weeks to formal questions Facebook sent to his lawyers which he declined to answer, claiming they were not relevant.   They include whether he had ever been involved in the sale of illegal drugs.

    In his action, he says the post was published, or caused to be published, by Facebook on its website headed: "South Armagh South Down ADM".
    It included a photo of him with the words including "biggest heroin dealer in Dundalk and beyond".

    He says the page was seen by his life partner and his friends. "

    Relevant to the case in Kildare in the context of libel/defamation of character on social media, if Mr Mcardle,s lawyers are able to to obtain orders for facebook to disclose certain info, surely the same thing could be done in the Kildare case an order for facebook to disclose certain info on the exact number of people who posted & shared around libelous posts.

    Are these animals going to be facing criminal charges of any kind? Apart from the harassment, are there any specific laws on vigilantism that can be invoked? Getting a bit ridiculous at this stage.

    Defamation charges against the posters on Facebook to start I would think. Collect screenshots, profile pics and URLs and hand them over to a solicitor.

    Yep, 'Print Screen' is a fierce useful function on a keyboard. These f**king clowns really do deserve a day in court. Appalling reading the latest link. It appears that man already suffers from mental health issues.

    Just came across this story today; a second man this time in Co. Kerry has been falsely identified as Luckwill and again as a result of a Facebook campaign.

    According to the article he's a homeless man and was hounded by a group of 'youths' (read a few brain cells failed to activate) , who took photos of him as they went about their activities. Presumably so they could post more pics of him on their Facebook timelines. Charming.

    What next from the hate Mob in Kildare on Facebook there is a `Muslim` on the streets of Kildare . He our she is a terrorist the Kildare mob on a the attack like what the Kildare Mob did to that Innocent Man. This is like Mississippi burning but it`s in Kildare Ireland instead of Mississippi .
    The Hazel Hotel in Monasterevin, for decades frequented by the likes of Joe Dolan, Big Tom, and Daniel O'Donnell, is now housing Syrian refugees, so the people of Monasterevin are well used to Muslims around the place. And as far as I know, there hasn't been any trouble with them.

    It's good that all of the prejudiced, brainless people in the country are concentrated in Monasterevein (or Kildare in general). :rolleyes: I'm sure whatever the people in whatever idyllic part of the country you are from is aghast at their actions!

    (I know I shouldn't feed the brain-dead troll.)
