    Why didn't OJ take the stand????

    why didn't the prosecution insist on it?? the man who was on trial didn't go on trial

    The prosecution could not insist. It's up to the defence if they had decided to put OJ on the stand then the prosecution could have cross examined him. It's not uncommon for the accused not to testify if it's felt they will not be able to testify well in their own defence

    but the man is accused of murder with a mountain of evidence against him so surely he must go before the jury and answer pressing questions ???

    (is it only in the States this happens??)

    Really enjoyed this series very good, even tho I found the fact they went for an exact likeness for every character except the main one OJ a little annoying..


    Makes you think tho remembering this whole trial and how an apparent racist individual became the bigger criminal than the 'murderer'

    It would have been madness for OJ to take the stand. As long as he didnt take the stand, his makey uppey side of events had to be proved wrong by the prosecution. If he got up on the stand, HE would have been responsible for making his ridiculous story sound believable. Plus they could have crossed examined him about what he said to the cops when he was in the Bronco during the slow speed chase.

    Another point that Bugliosi made was that when OJ was in the Bronco, he was apologising to the cops for having caused such a fuss. The point being that if you WERE innocent and being fitted up for the crime (as was the assertion of the defence), you would be absolutely MAD with the cops, not apologising to them.

    Yeah this really got to me as well. Cuba really looked nor sounded nothing like OJ. And the fact that he was physically so much smaller than everybody in real life that he was towering over. Enjoyed it hugely as well though.

    No of course not. Look at tons of other cases where the defendent wasn't compelled to testify. One example here is the Graham Dwyer case

    We're back to "innocent until proven guilty". An innocent individual has no obligation to place himself in jeopardy and submit to interrogation by the prosecution.
    The only places where the prosecution can compel testimony from the accused tend not to be countries and/or times I'd care to visit.

    Couple of things about the gloves, did OJ have paper gloves on in the trial when he tried them on....don't recall he did

    And how could Shapiro walk up unnoticed by a full courtroom and tamper with evidence.....surely he couldn't have been allowed try those gloves on like in this programme....or was it just 'artistic license'

    but if you claim to be innocent why not testify and give your side of the story?? by not taking the stand it looks worse it looks like you've got something to hide

    But it's up to the prosecution to prove you are guilty not for you to prove you're innocent, having something to hide doesn't make you guilty

    A good prosecutor can take things you say and twist them. They basically use what you say against you. And you might think if you're innocent that will be obvious as you will be answering with the truth so they can't 'catch' you out. By staying silent they have nothing to work with.

    I watched a few trial documentaries recently and since then the thing I came away from it was to never take the stand

    Watching it on RTE. Really is great telly.
    Can't believe how much of a circus it really was.
    The Bronco "chase" at 35mph. The highway deserted. The spectators with their "we love you, Juice" placards (first thought seeing this: humanity really is doomed).

    Bizarre.

    Shapiro and Cochran, two big egos there. Enjoyed Connie Britton's turn and the jury research, etc. The scene where the father told the story about his son was quite moving.

    Just in case anyone wants to know espns oj made in america aired last week and is truly fascinating when looked at after this a far more in depth documentary about america as a whole at the time and OJ as a person.

    its 5 parts and each part is an hour and a half long
