    no it isn't. the crime was commited elsewhere, therefore it is an elsewhere crime. in relation to this chap, he commited his supposed crime in ireland, therefore it is an irish crime even if it isn't against ireland.

    Pity the High Court doesn't do makey-uppy charges - he's going to America :P

    Threatening to have the FBI agents involved shot won't help :
    Mr Davis told a friend he would have FBI agents involved in Silk Road's closure shot.

    If you're facilitating a drugs transaction that is happening on American soil, it doesn't matter where in the world you are, the crime to which you are a conspirator is happening in America.

    For the exact same reason, if the Kinehans are ever pinned to a drugs transaction in Ireland, the authorities here can seek to have them extradited from Spain.

    I don't know why I'm bothering arguing with you, it's probably a waste of time since your modus is to just deny & ignore facts, and flatly say 'no it isn't', with absolutely no logic to what you're saying.

    he commited it in ireland, so therefore should be tried in ireland where a higher standard of evidence will be expected. also, he wouldn't be sent to an american reoffender creation factory if found guilty

    I don't know all the ins and outs of this website, but considering its on the dark web and the transactions involved, I can't imagine he moderated those topics for the good of his health. I'd assume there was money involved.

    Wonder what sort of proof they have.
    With the owner of the site they only had pictures of his admin screen that they took after they ambushed him in a library while he was using free wifi. He couldn't lock his screen in time.

    Sure I suppose if he isn't extradited legally the good oul us of a, will just send some of their heavies over to kidnap him, shove a tranquiliser suppository up his arse, chain him onto one of their planes in Shannon, transport him to somewhere we know nothing about and torture him until justice has been served.

    There are times where it has to be accountable, or in this instance the user. This is part of the problem; people think they can do whatever they want on the internet and not be prosecuted for it, be it cyber bullying or having a hit put on someone.
    It is claimed as part of his role Davis dealt with queries from the sites users, and he re-organised certain items that could be purchased on the website into different categories.

    If the above is true, he had knowledge of crimes taking place.

    Bumping this: Gary Davis has been taken into custody ahead of his extradition to the United States.

    His extradition was ordered by the High Court last August. He appealed the decision which was dismissed by the three-judge Court of Appeal today.

    Mr Davis had opposed his extradition on grounds that he suffers from both a form of autism known as Asperger's Syndrome and depression.

    He has a pretty sh1t solicitor if I do so say so myself.

    Now I am not going to deny that sending his ID as "assurance" before he could become a mod was very dumb.
    (This is mainly how he got caught BTW)

    Where and when would his Solicitor have presented a case of mistaken ID?

    Presumably a warrant for his arrest issued in the States, and the grounds for fighting extradition are extremely limited. There has been no proper airing of the evidence against him, that would come at a trial, and that trial will be in the States.

    The 15 days post verdict has now expired, but I haven't seen any reports of the extradition having taken place. Has he gone?

    Supreme Court has agreed to hear a further appeal.

    Honestly, If one drug was sold in the USA as a result of his direct activities facilitating the trade on the site he should be extradited there.

    I wouldn't want some drug dealer or kiddie fiddler to get away with distributing in Ireland from Cambodia.

    Autism or whatever shouldn't be an issue.

    Someone who commits a crime shouldn't be "let off" because they're autistic.

    I happen to agree with the US system of treating all adults as equals in front of the law.

    they have to be if their autism is severe enough. our system with it's faults is better in that we insure fairness and equality rather then simple equality but no protection for people.

    Pretty sure they have lawyers in the USA. And pretty sure their legal system is nuanced enough to factor in the effects of autism in either a verdict or a sentence, it's not wholly unlike ours. He won't be dunked in a pool to see if he floats or not to reach a verdict.
