    It is not impossible but anything past one, maybe two away from the genuine rating would be found out very easily. Simply having the MPRN when you move in would give you the ability to get the BER rating. You could also ask the estate agent for a copy out of interest, and run the number to confirm. They should have it as they would know that you can make a complaint, again, adding hassle for no benefit.

    Why would you go to an engineering company, a quick google would have told you how to get the actual BER quickly and easily.

    Why would an estate agent do this knowing they could actually give a worse BER rating then it actually has and still rent it for the same money.

    And for what? Risk your good name for a months rent a year from a person who could actually turn round and attempt to bribe you as well as the landlord would then have proof you were doing it.

    Well, the RTB confirmation they received the termination notice on the valid date, was finally delivered.

    So I guess that means everything is above board and the probability is the LL is legitimately selling, and it's not the auctioneer being salty.

    And that's perfectly fine, so long as I'm not being "ousted", and the motivation is legit.

    Still though, I will want to follow up later and ensure the property went through the sales procedure.

    Is there some website that sales listings appear on to confirm this?

    It doesn't actually matter whether the owner was influenced to sell by this agent or made their decision independent of the agent as long as the owner follows through with a sale, you could be 100% correct in all of the crazy allegations but it wouldn't make a difference.

    I appealed to the LL to tell me what he was looking for but he didn't even respond.

    And he wants me out before commencing viewings even.

    Presumably he's going to polish it and try and flog it for the most inflated rate possible, which in this market will be astronomical.

    Last time I was evicted, the LL made an offer to me before auctioning it, out of good will as much as anything as I had been such a good tenant for so long……… and like a dope I passed on it thinking this "housing crises" will blow over.

    3 years later…………. check me out now.

    Nah, the LL wouldn't have followed through with a sale based on influence from the agent, just possibly agreed with turfing me out upon their advice/request.

    That was speculative on my behalf but, yeah………. water under the bridge, not opening that can of worms again.

    Provided the LL is actually selling for real and wasn't scamming me, that was basically what I was putting under the microscope.

    I'm just compiling a reference which hopefully the agent will copy/paste with their letter head, cause getting future digs will all depend on reference quality.

    YYou Were vert naive to let tgat opportunity pass….however many are where property is involved. Many fail to accept that from 2010 -2018 and later in smaller burban areas property was below build cost so undervalued.

    Demand rose exponentially and values rose with it. There was never going to be a quick solution to the housing crisis. Any corrections will be in the order of 10-20%. I did the calculations for a poster here around the same time you indicated he needed a 10% fall in value to break even between paying rent and thr way interest rates were rising at the time. When you are talking about your own home the best time to buy was yesterday the next best in present circumstances is ASAP.

    Because of the present market tge present LL wants to achieve full market value wich putting it on the market vacant is the best option.

    If the last LL.sold at auction it may have been an agreed bank sale. He would have been discounting to you. Finally every year you wait is a year shorter in mortgage finance you can get.

    Update:

    I ran the documentation past threshold.

    They noticed something that got past me.

    The Notice of Termination was filed with the RTB one month after it was filed with myself.

    One month to the day, exact date.

    I received RTB confirmation of their receipt, 8 days following this, where they normally provide this 7 to 12 days after.

    Not 6 weeks after.

    Does this seem suspicious to anyone?

    Or just a possible typo in the RTB filing and the whole thing is a tremendous coincidence?

    It means the NoT is invalid. As I said the RTB aren't that slow at getting out the conformation letter.

    Pffff, I know I shouldn't listen to random strangers on internet forums, but some other poster claimed they were ridiculously slow typically and I should disregard the significance of a late confirmation letter, and that the NoT was still almost certainly valid.

    So………. the RTB receives the NoT, filed……… TO THE DATE…… one month later.

    What does this indicate?

    The landlord or agent is just slow off the mark?

    He just, by pure coincidence, happened to file it with the RTB on the exact date, one month later?

    The RTB made a typo?

    Or……………. pivotally………. could the LL/agent be pulling a fast one?

    I have one week from today to open a dispute before the 90 day period expires.

    Been through this with the RTB three times. If the landlord makes a mistake then the NoT isn't valid. Get on and open a dispute. Its the disputes where the RTB get really really slow.

    I shouldn't be concerned about that potentially souring my relationship with the letting agency by filing a dispute?

    As there's still the possibility they could source me subsequent accommodation.

    Just out of curiousity, when you went through the dispute process, was it just a mistake made by the LL/agent?

    Or was an unlawful eviction in effect and you ultimately got to stay?

    They haven't got you accommodation yet, they are prepared to get you out without going through the correct process and then fudging it to make it look OK.

    I have been, every couple weeks since receiving notice, but their response has consistently been, "nothing is available", which in this market is quite believable?

    On the other hand, they have a long standing chip on their shoulder against myself, so it's hard to know.

    How could they make such blunder?

    And how was it possible they filed the NoT with the RTB, on the EXACT same date they filed it to me, but the following month.

    This is a professional and established real estate brokerage we're talking about.

    Bearing in mind I was excoriated by many other board members here for considering the possibility the agency (some of whom hate me, and always have), may be pulling a fast one to try and get me out.

    I still can't say that's the case, but a misfiling of a notice of termination, with that large a time discrepancy, how does that happen?

    You do come across as a bit of a handful to put it mildly. Thankfully I don't have a property rented to you and am not surprised the agent is having issues with you. The owner of a property where you rent wants to sell his/her asset, you've got an issue with that and instead of trying your utmost to find another place to rent, like many others, you're on your high horse saying all sorts. For the love of God, go out there and try to rent another place. You mightn't find what you want, but you'll find something. That very same home owner who rents to you might well have serious issues you know nothing about, many have. Asking AI and suchlike won't solve your problem now, just get yourself out there. Any potential person owning a property and wanting to let it wouldn't be too inclined to rent it to you from reading your issues on here. I wonder why?

    Put the "professional and established real estate brokerage" out of your mind and substitute "human".

    I've seen multiple mistakes made by "professional" solicitors in documentation and its execution. Then of course they try and minimise the mistake as if it never happened.

    What I'd do is raise a dispute asap - registered post - and inform the agent that you have had to do this as you haven't yet found alternative accommodation. You are still looking and if in the mean time they can find you something suitable you'll be happy to move on.

    You're relentless.

    You started off with one query and as time has gone on you're trying to pick holes in absolutely everything to try stay in the property.

    Regardless of what loophole you'll find, at the end of it all you'll still have to move, because you don't own this property. It could take weeks, months or perhaps more for you to realise this but you're tarnishing your own references by acting the maggot.

    So @GalaxyRyder the date the notice of Termination went to the RTB was a month late, does that invalidate the entire process?

    Or have you just bought yourself an extra Month of possible Tennancy?

    What are you going to do now??? sit tight until January and shout gotcha!!! when the Landlord arrives 😂

    Landlord has been sound enough with you so far and this could get very ugly....probably ending up in court/Sherriff/Gardai

    If it arrived it will invalidate the entire process and the LL must start over again if the notice was not posted to the RTB in a timely manner.

    HHowever If @GalaxyRyder rider rises a dispute while he may win in the short-term by being allowed to stay another 3-6 months plus it will ve harder to find a property with his record of rising the dispute.

    It's purely up to him what course he decides

    That's a little dramatic………. though I have to say the idea of waiting until the initial termination date and shouting "gotcha!" when the LL shows up, as the other suggested, does sound appealing.

    I could video it then post it on social media!

    "Tenant pawns sloppy landlord!".

    In seriousness though, what I really want to know is whether this process is genuine.

    Technically at this point, I'm 90 days removed from the notice, so I would, at a minimum, buy myself another three months of occupancy.

    And on the point of filing a dispute, the above suggestion, outlining to the agent I had to do so as nothing is available, but if they found me somewhere I've move on no sweat, that sounds like a fair workaround to avoid completely scuppering my relationship with the agent.

    if nothing is available and you think the agent isn’t really helping you because they have an issue with you already, then you have the answer, and nothing to lose. File the dispute.

    Worst case nothing changes and you have 3 months longer, best case they miraculously do something to end the dispute and find you somewhere

    It doesn't work that way. Unless its been through the RTB process correctly the courts won't want to know about it. Thats part of the point of the RTB it reduces the work of the courts.

    If the notice is incorrect the process needs repeating and the clock starts again. If the error is not prejudicial to the original NoT then if the tenant wins they may only get another month stay of execution but with an error like stated here I suspect the notice period may restart. The agent could have just reissued the NoT when they spotted their mistake but they didn't instead they tried to cover it up.

    However the process can take 6 months sometimes more so win or loose it gives the OP another 6 months tenancy and if they loose they can appeal and that will take another 3 months.

    Wake me up when it's all over.
