Running red light

Ran a light that had just went red. Pulled over by Guard who didn’t take any details just asked what license I had and I said full. Said I should know better and told me to be safe. He didn’t take my details or my license. He didn’t notify me of any fine or points. Will I still receive them? Or was it a slap on the wrist.

Thanks for the reply. I was thinking maybe he recorded my reg and is this simply enough to find the car on the database and issue a fine in post

That's illegal. If he stops you in person he has to issue you a fines notice.

Yes he does. He can't stop you and say on your way and then issue you a notice in the post without notifying you prior.

If your stopped in question you have to be issued a notice and fine so its recorded for legal purposes.

Again, no you don't. Gardai can stop a vehicle for any reason or no reason, issue a fine there and then or later. Inform you or don't.

Again, it won't. There is no statutory or even internal Garda policy requirement that you to be informed.

You've flip flopped between it's 'illegal' to a Garda having to tell you to them not being able to stop you at all unless they're giving you a fine, all of which is nonsense. You'll be telling us next you have to be given a paper ticket.

One of us deals with this daily...and it's not you so I think we'll leave it there, your failure to back up anything you've said speaks for itself I think.

Unless you're issued a notice there and then or if there's a camera on the lights its the guards word against yours. If you're of law enforcement maybe you could enlighten me otherwise it'll be stuck out.

You should visit your local District Court. The vast majority of road traffic cases are prosecuted based on the oral evidence of a Garda alone.

I don't really understand your point all the same. You're saying that a Garda needs to issue a notice on the spot (they don't) or otherwise it's just 'the guards word aginst yours'. I'm lost - how would the issuing of a notice change this?
