    However the mod decided to leave this in place and delete my reply to same.
    With all due RESPECT mod this is not how i believe a forum is supposed to work.

    Back to topic the decision has being made and the contributions here have being very helpful in the decision.
    He is going to plant ASAP ant Teagasc and Social Welfare can sort it out.
    Farmers here please note that the Teagasc advisor i spoke to said the majority of the land they grant aid is planted is because of neglect of rented land by the tenant. The advisor looked at the land and advised owner to take pics just in case, he agreed the land neglected as the fields both sides are in very good condition.

    Surely the best advice is to stay out of someone else's legal problems and advise the 'friend' to speak to a solicitor.

    This is not a legal problem...

    If someone breaks a contract, it is indeed a legal issue.

    Your friend needn’t worry too much about the condition of the ground if he’s planning on planting it in 2 years.

    All we are trying to do is solve a problem created by someone else, if the leasee had behaved in any reasonable fashion the problem would not be there.
    The ground will recover in a couple of months but that's not the issue.
    If the farmer decides to go legal he can but he is the person who dishonored the original agreement.
    I do not know if there be consequences in payments for the leasee as i assume when Teagasc get involved all be sorted...

    So - to confirm, your friend had Teagasc out to look at the land for planting, knowing he had the land let for another 2 years? Thats fair enough, planning is good...
    But he has made the decision to plant ASAP, and break the lease - without talking to the tenant?

    Do you not see how underhanded this is being?

    This sounds like your friend doesnt like how the land is being farmed, and whats it to look as nice as the neighbours.
    Thats not how leases work - you lease out your land, you must accept that someone else will farm it, and you dont get to dictate what it looks like...

    Again, I would say get your friend to talk to the tenant, they may well be glad to exit this situation as well...

    What specifically have they done to the land in the 3 years ?
    Seems like its just sheep on it grazing ,any pictures of the damage etc ?
