Lands preserved

    What’s the deal with the lands preserved notices in local papers? Why do farmers even have to do this? It makes it seem like if they don’t do it then people have some kind of right just to go hunting on their land without asking.

    "Lands preserved" has always meant (to me) no shooting at all. In gun clubs it's used to stop members shooting land that is placed aside for various reasons, and in private permissions it's placed there by the land owner to stop shooting altogether.

    If you place "lands Preserved" signs up then you are in effect stopping all shooting on those lands. So permissions would be void.

    As for the advert in the papers i believe, and perhaps i'm not going to explain this well but you'll get the idea, by placing the advert in a local paper you have given clear and legal notice that the lands are preserved and no shooting can take place. So if someone is found on the land they have no excuse for not knowing and can be prosecuted.

    A certain amount of people seem to presume they have a right to enter land whether it be shooters or hunters. Placing those signs gives a clear indication that the owners does not want that activity occurring on their land.

    My understanding of putting the notice in the paper is that, the Secretary of the Gun club can take the poachers to court on a civil action without the land owner or Guards having to go to court, ie Club x gives evidence of Trespass or Poaching direct to the Judge, so long that he can show they have shooting rights of x ground.

    The only way the tressapper could prove otherwise is for the Land owner to give permission to him to be on the land , in court, or they did not know it was presented

    Put it in the paper and they can't say they did not know.

    That's pretty much it. Put up the signs, back it up with the notice in the local paper and a judge will be satisfied that poachers have no excuse for being there. There have been court cases in the past where the judge has specifically asked if a notice was placed in the local rag.

    Ignorance as a legal defence,...how some get away with the crap they're at is beyond me.
