Speeding fine and 3 points

Hi people. Has anyone any experience with appealing these?

I was done doing 69km in a 60km Road. I wouldn’t usually appeal something like this as I fully agree that speeding is wrong. However, I was driving my pregnant wife to hospital, she was heavily bleeding and in bad pain, I was extremely worried. I wasn’t flying, but I must have creeped over the limit.

Hospital has sent a letter of confirmation of date and time and seriousness of the incident.

Any body would’ve done what I did. So anyone familiar with these things? I’ve never had a previous issue with speed.

Even fire brigades and ambulances are required to obey the rules of the road. You were clearly over the limit. There is no "my wife was giving birth" speed limit.

In short pay the fine and concentrate on more important things.

You have absolutely no chance of getting off. So I don’t see the point.

..........You were clearly over the limit.

Reckless behaviour if you were over the drink driving limit, speeding and driving you pregnant wife to hospital, id throw the baby at you for that.....the book I meant:)

Have you read the letter accompanying the fine? It clearly states that's a ground of appeal. May as well try it.

    Edit: 69 eh! Geddit?

Emergency Services are not compliant with speed limits or red lights in emergencies. Fair enough you’re a troll, I feel sorry for your type. But at least get your facts right.

Pay your fine and take your points. There is no impact to insurance premiums til you have at least 4 points, so be extra careful for the next 3 yrs til they are wiped

Couldn't Colm Meany rushing to hospital so that'll have to do.

Are there speed vans actually out in 60 zones?

i believe the superindent still has authority to cancel tickets if it is a garda speeding fine, contrary to what the public want!
if it is one of the other fines, there should be somewhere on it an address to appeal to?
what ever it says on the ticket is best, email or letter.
    no harm in trying

You can speed in a genuine emergency. Assuming you felt this was an emergency and the hospital agreed you should appeal.

Was no letter with fine. I did read that allowance of 10% speed limit is given plus or minus 2km/ph that would be 60km Road 10% plus 2km is 68km. If that’s the truth, I was 1km over what’s allowed. But that’s not the point.

Really? Ive had 3 points for 2 years now, my premium actually went down the first renewal i had after they were issued, was told by a guard that 4 points+ is when it impacts.

  • Closed Accounts Posts: 16,705 ✭✭✭✭Tigger

Judge will let you off but get a solicitor to confirm thi s
If it was me I’d try to contact the gaurd that issued it
If it’s one of the vans then you’ll have to go to court

There is a slip with the fine stating that under exceptional circumstances, such as a medical emergency, you can appeal the fine. Read the whole thing.

€70 loading on mine for being a naught boy through Fairview. I expect it varies by insurance company.

When did it change? I got done about 8 years ago for doing 70 in a 50 zone (guilty as charged)and got an €80 fine and three points on my licence. It didn't impact on my insurance.

Where did you read that? There is no allowance stated in any legal document.

UK standard. Not sure it applies here.

There's no blanket increases lads, it varies by company.

There's an insurance company out there that doesn't load at 8 points? There's more chance of me having a fling with January Jones.

If my pregnant wife were bleeding and in pain, i'd be doing a damn sight faster than "creeping over the limit"....I really don't know who wouldn't.

There comes a point though where the speed will be unacceptable and a bigger danger than the emergency in the car. It's no good to anyone if you go slamming into a wall at 100KPH in a 50.

3 points for 9km with adjustments sounds like a lot.

    What gets you 1 point?

Driving in the bus lane apparently. I got done at 58.

So doing 69 in a 60 zone is the same fine and points as what I got last year doing 150 in a 120 zone on the motorway?

And yes my insurance went up by €100 because of the 3 points.

You still have to drive safely.

In this case I think it's better to call an ambulance that can negotiate speed , traffic and traffic lights whilst the patient is receiving medical attention.

Don't see how the OP can appeal it. 69kmph in a 60kmph zone is more than "creeping" over the limit. It's 15% over.

Where did I say anything about 8 points? All I'm saying is that some insurers will load at lower points than others

And Christina Hendricks is better :p

  • Registered Users, Registered Users 2 Posts: 969 ✭✭✭Greybottle

Had something similar OP. Appealed it in court. Agreed to pay €100 and got no points.

Depends on the judge, though the one I got would be considered a hard enough one.

Have never had points or fines before which helped.

Original offence was 61 in a 50 zone in a small rural town at 2 am. Got €80 and 2 points originally.

You would be great to have around in an emergency.

Of course I can appeal! I was asking if anyone has experience in this situation, not an opinion from someone you divides 9 by 60 gets 15 and everything in this world is black and white.

Try dealing with an emergency in real life.

Thanks for that. So it’s worth going to court. Mine was 3:30pm, but on bank holiday and clear roads. Same as you, driving 18years continuously without any ever issue. I genuinely hate speeding and dangerous drivers, but emergencies are different.

No! For the third time, appeal directly and look to have the fine cancelled in the first instance.

Was this a GATSO or a Garda ticket? If Garda I’d pop into the station first with the letter and see what they say. I’ve heard anecdotally of people having it squashed.

It's not as grey as adding 10% to a speed limit and then chucking on another couple. Why not throw on 3 and you wouldn't have been speeding at all?
