Is it foolish not to be covering either mortgages or landlord and tenants? For property
    I'm not covering either.

But I might do a small bit on mortgages as a backup.

I hate Landlord / Tenant though - awful topic.

Note covering either, even though I fancy them both as quite likely. But I think

    Succession x 2, Easement x 1 and AP x 1

Then I need to get 1 out of Finding, Licences and Estoppel, Co-Ownership, Family Property, Backup level of registered and unregistered.

I think that'll be safe as at least 3 out of 4 for the top one is likely and I'd be shocked if 1 / 2 don't come out of the bottom row given that there'll be space for 4/5 more questions in the exam?

Would need to be very unlucky and get landlord one question, Mortgages another and then 2 off the wall ones to get caught!

Has anyone been able to access the city colleges night before notes?

I'm leaving out ultra vires and receivers (as it came up last sitting). I am doing winding up, share transfer, and hoping to do corporate authority if I have time!

    What is legislative control ...?

It is the provisions dealing with transactions between directors and companies

Does any kind soul have a copy of Companies Act 2014 that I could borrow for the exam?

Thought you could buy it in Easons like I did for the Constitution in the last sitting. The panic is real.

I do! I'm not sitting it this time, but have tort and criminal so could leave it for you somewhere monday and you could leave back for me wednesday?

    tort -- Ward v McMaster

Am I right in thinking that a duty of Care was imposed on both defendants (local auth and the builder) in Ward v McMaster but it was discharged against Louth Co Co for public policy reasons?

My manual is saying 2 different things in different chapters!

I don't think they have released one yet. It's the only one not up on their website.

I would imagine he could be either / both. He's inciting and likely aiding/abetting/procuring when he gives him the weapon, once the bro commits the offence surely that's common design? (NI case maybe Lynch where he drove them to the pub they threw the bomb into?) and disposing is accessory after the fact.

    Gracias amigo

Could anyone tell me why UCC v ESB came under Nuisance and not Rylands? I have a hard time telling them apart.

Has anyone any case law on SAP? My notes don't have any cases, and the Company Nutshells doesn't either. I notice in the Oct 2017 essay Q on SAP he states "…you must cite all relevant case and statute law", but fails to include any cases in the examiners' report!

Hoping someone can answer this for me bc it's been bugging me for ages... In property is a spouse entitled to take the LRS in addition to any property left under the will or is it only exercisable if they were effectively left out of the will? Thank you!

The spouse is entitled to take the LRS over a gift (right of election). However, S.56 allows the spouse to compel the executor to take the house as part of the LRS. If the house is worth more than the LRS the spouse can raise the difference or (S.57) if they can rely on a child's share if the spouse is a trustee of the child and the child will get part of the ownership in the property. If the house is worth less than the LRS they get the house plus the remainder (LRS minus the value of the house)

I would prioritise Directors’ Duties, Restriction of Directors, SLP, Corporate Borrowing, Shareholder Remedies (s.212), Winding Up and Distribution of Assets, Share Transfers

Oh okay and say if a spouse is left something in the will can they take the LRS as well or is it just instead of?

I don't either, nor do the couple of sample answers I have on it. So I'm not too concerned!
