1 month warranty on a 2013 car?!

Hey, so I bought a 2013 Ford Focus a month ago, (and 2 days) after a few days of driving it I started to hear a grinding noise when i'm taking my foot off the clutch, so I brought it back to him and he kept it for 2 days and then gave it back and said the noise is fixed, that it was the breaks. But still the same noise, getting worse by the days, louder and louder. Have sent him messages saying it's 100 per cent the clutch not the breaks, and just been told he didn't hear a noise from the clutch in the 2 days so basically will not be replacing the clutch as he can't hear a noise. But I know for a fact he's lying as everyone who is with me both parents etc can hear the noise, I could hear it for 5 minutes straight when taking foot off, or not hear it for only every hour or two, comes and goes.. Sounds like the release bearing is going!! Also engine management light keeps coming off and on, so brought it back to him and was told 'its a sensor' .. The other day I got a flat tire and brought it to a garage, we got talking me and the mechanic so he put his computer on my car and found 2 problems, 'Diesel particle filter' - soot accumulated and - Catalyst converter too low during regeneration.. Also he heard the noise from clutch and told me it's the release bearing... I only got 1 month warranty with the car and all these problems, the mechanic told me I should bring this to court and also questioned why only a 1 month warranty with such a new car.. Dealer told me it's 'comprehensive' as that's why I only got a 1 month warranty. What can I do as i've given this fuc)er almost 13,000 and have been robbed!!

By law the motor dealer must give you a 3 month warranty.

Can you detail the location of this "dealer"

    Is the car on finance?

What kind of dealer was it? No legitimate garage offers a 1 month warranty on a 3 year old car. Do you have a warranty in writing?

    Yes it's on finance

I'd park across the business entrance, blocking all access, and going for a chat with the seller.

Might go and pick up a coffee first, after parking the car.

Is this the law of 'I've just made it up'?

Clutch isn't covered under any warranty what mileage is on it.

Dual mass fly wheel on its last legs.

I guess car was ex rental.

Yes, there's several cases outlined stating this law, namely Mr. MacItup Vs. Lawless Car Sales Ltd

Did you do a history check on the car prior to purchase? Did it have a service history?

Have everything, all service history etc. Was an English import so they where all done in UK so he says

Just cause only 61k doesn't mean nuts weren't smashed out of it.

You could go in say look need it sorted or that but as said clutch isn't covered unless you can prove it was damaged or completely worn out prior to you buying.

I started hearing the noise 2 days after buying the car , I mean lets be honest here. The dealer knew exactly what was wrong

So did you run a history check on the car?

    Run away

    At great speed

  • Registered Users, Registered Users 2 Posts: 73,522 ✭✭✭✭colm_mcm

Or go back in time and run away at great speed

I would've thought the date you reported the fault would be more relevant than today's date. As in if on the off chance your warranty was actually going to cover anything, the date you report the fault would have been within your warranty period.

I would do a history check on the car and verify the service history.

I remember you now. You don't have much luck with cars.

Does the car really only have 61k on it

Did the puncture repair guy charge you for the diagnostics?

I find this whole story quite strange.

    Are you spoofing us OP?

Put reg into history check and see.

Buying a 3 year old car from a garage who are only offering a 1 month warranty on it is crazy. If the garage have only that little faith in it then it should trigger alarm bells with a buyer. You also need to verify the service history by contacting the garages that serviced it, not just accepting the word of a car salesperson or a stamped piece of paper as it's very easy to forge them these days.

As for the problems now, I'd say you will have a battle on your hands getting any satisfaction from any establishment that offers such piss poor warranties. My advice is go get some free legal advice from the likes of the National Consumer Agency and Citizens Advice Bureau and see where you stand.

Put reg into history check and see.

Have done that, nothing suspicious coming up. Only about the tax being out but it's taxed etc now after I bought it

  • Registered Users, Registered Users 2 Posts: 187 ✭✭Mccabe96

Not before I bought it as I took the dealer at his word that everything was perfect, little did I know it wasn't

The car hasn't broken down, it's just making a noise. Hard to see how you can expect the garage to fix a noise which they can't hear. In your head it probably sounds worse as time goes by, but it doesn't need fixing if it hasn't broken.

In view of your tyre fitters diagnosis, I'd say there's a good chance it's been clocked though (or not driven as a diesel should)

Have you put in the uk reg? Does the report cover the uk as well?

  • Registered Users, Registered Users 2 Posts: 23,688 ✭✭✭✭mickdw

Probably had a UK mot so stick the reg into the mot history site. Could be interesting. If it's shown as clocked, you will be able to soften the dealers cough rather quickly and get your money back.

So if I hear the release bearing going in the clutch, I should just leave it until the clutch is fuc(ed ? And no, it is getting louder and louder, isn't in my head.

Put in the Irish Reg: but it gives the English Reg etc on the check , doesn't show nothing wrong on anything

When I enter in the English Reg for the MOT , it says it can't find a vehicle with that registration

    Is it UK or northern?

If its to new for mot it won't have had one.

It could have been imported here before it had to do it's first MOT. Are you the first Irish owner OP?

Although there's a bigger picture at play here, a clutch release bearing or DPF wouldn't be covered by a warranty anyway.

Go back to garage and ask him to get in car while you drive it for a while bring someone else with you as witness.

It is something you would expect to be working when you bought the car though?

  • Registered Users, Registered Users 2 Posts: 24,644 ✭✭✭✭punisher5112

When did the noise start was it weeks after buying or within days.

I would go back tell them it needs sorting as you bought the car which should be mechanically sound and last longer then a month.

Its either clocked or had many rough drivers sounds to me quite likely a ex rental.

Absolutely, but the sort of gentleman offering a "28 day warranty" is going to make it your problem to prove that it wasn't.

  • Registered Users, Registered Users 2 Posts: 8,922 ✭✭✭GM228

Not sure if already asked but did you check the status of the manufacturers warranty OP?

I think it was around 2012 or 2013 Ford started offering 5 year warranties and I think that included the Focus?

Another thing to note is what a lot of people seem to forget or not know that many problems/faults must be made good by a seller even if outside the warranty under the Sale of Goods and Supply of Services Act.

Absolutelt, but the sort of gentleman offering a "28 day warranty" is going to make it your problem to prove that it wasn't.

If a fault occurs within 6 months of purchase there is a legal presumption that it was present at time of purchase. You do not need to prove it and the seller must remedy the situation, infact it's actually the opposite, the seller must prove the fault didn't exist within the first 6 months.

In essence there is a statutory 6 month warranty (subject to a seller disproving the fault existed at time of purchase and subject to the type of the fault such as wear and tear etc which obviously is not covered) on any goods bought in Ireland (and the EU), too few people seem to be aware of this.

    1. Bring the car back to dealer.
    2. Show him the picture you took of the diagnostic read out.
    3. Tell him to fix the car or you will go to your solicitor.
    4. Walk away and leave the car there and tell him to ring you when he has fixed the car that he knew was faulty when he sold it you.
    5. If he's a main dealer, report the whole thing to the head office.
    6. Never buy from him again.

I was given comprehensive warranty; and all is covered by comprehensive as far as I'm aware, the clutch is anyways as he told me before before I bought the car eveb
