Snobby Artist sues love/hate!

    Kevin Sharkeys to sue for hanging a few paintings in John boys gaff!


    A DONEGAL artist is suing the makers of the hit RTE TV series ‘Love/Hate’ claiming a breach of copyright.

    The Dublin gangland crime drama has featured three of Kevin Sharkey’s works during the first two series of the drama.

    The paintings could be seen hanging in the luxury apartment of crime boss John Boy, played by Aidan Gillen.

    They were also on view as several characters were filmed taking drugs for the series.

    Sharkey’s solicitor Joseph O’Malley confirmed that artist Kevin has filed for damages against Octagon Films and RTE with the High Court.

    Mr O’Malley said the legal action related to an alleged “infringement of copyright and a consequential claim for damages.”

    “I love what I have seen of ‘Love/Hate’ so far and my decision to pursue the producers is purely a legal matter,” said Sharkey who has complained that his art is being used in the series.

    “Having my work portrayed as liked by a dangerous killer and drug addict is the problem. It might seem cool to the lads in Ballymun, but they don’t buy my paintings.”

    If RTE own them then surely they can display them anywhere they like. I'm not aware of anything like IMRO for pictures. Or is it that he doesn't want his pictures associated with drug taking? In which case I'd refer back to - RTE owns them, they can display them wherever they fancy, as long as they don't make unauthorised reproductions or use them in advertising.

    I have never seen Love/Hate, but are the indoor scenes filmed on location or on a set somewhere? There's a chance that they happened to be there if they were filming on location.

    TBH this smacks of the same sort of Mé Fein stuff that wedding photographers do where they hang on to the copyright so the can fleece the guests as well. :mad:

    I can't disclose the format of the paintings as of yet, I believe there are some Germans seeking their whereabouts at the present time.

    I have them in a cellar, would you care to come see them, it's a dark cellar:D

    I remember when utv were filming in my house before for the irish come dine with me auditions they had to take a list of all the art work on the wall so that if the clip was used it could be cleared for copywrite so there obviously is something in his claim. Dont think its reasonable for him to have a problem with it though. Hes one of the countries most popular artists. I cant see rich people stopping buying his work just because they seen it on love hate.

    That's because you could have copyright prints on your walls. An original artwork is different. I could see people not buying his art due to the connection.

    Although I am not sure how copyright works for original art work you own. Not sure if you own an art work you have all copyright protection to put it on merchandise. The artist must retain some rights for use of their name etc... Especially if you consider many artists use a theme that can often create very similar works.

    Maybe he has a point. If his paintings get associated with the gangster art, he might not be able to sell them to his intended audience. Also "the lads in ballymun" probably wouldn't buy them anyway.

    Its kind of like those Scarface prints in a frame. At one stage (many years ago) that was a cool film buff thing to do. Now its every scumbag who wants to be gangster or a rapper has one hanging in his bedroom.

    He was surely paid when the picture was purchased ? If I buy one of his paintings and hang it in my home or office, do I need to to take note of the number of people who view it and send a cheque to him based on this every year ?

    And why has it taken him so long to decide to sue, surely the popularity of the show has nothing to do with it.

    Lot of people misunderstanding basic copyright here. The artist (be it a photographer, musician or painter) owns the right to make copies of their work or exploit it commercially, no one else has that right. If RTE bought a painting they bought a physical object, they don't automatically inherit the right to make copies of that work or use it commercially. Using the painting in a TV show is exploiting it for commercial purposes. You can't use a song on the soundtrack just because you bought the CD, either.

    You mean when they exercise their legal right to gain income from copies of their photography, which is how they pay their bills and recoup the immense cost of their equipment? What a load of ingrates! Idiots should know that you have the right to their photographs just because you attended the wedding.

    Of course he's entitled to be pi$$ed off. Sharkey's a brand, aiming to appeal to a particular demographic.

    By associating his product with a particular lifestyle, viewership and audience, RTE has potentially damaged his saleability among those who had traditionally bought his pieces.

    I cant remember who it was that said a while back that 'Rashers' paintings were like something Quentin Tarantino would buy so im surprised some of his work wasnt bought by the producers for the show.

    Sharkey's lawsuit has a thinly veiled sense of 'I done those in case you didnt know' about it.
