Man walks free from court pending appeal after being jailed for three years for serial rape of daughter!
A man who admitted sexually abusing his daughter at least once a week for ten years has walked free from court after a judge jailed him for three years but granted him bail pending an appeal.

    http://www.rte.ie/news/2013/0121/patrick-o-brien-rape.html

This is unreal, bail pending appeal, he should be in jail!
One has to wonder if sexual crimes are taken seriously by the judiciary anymore.
"Mr Justice Paul Carney said it was one of the worst case of abuse of a daughter one could possibly find and it was at the top of the scale.
However he said he had to consider the health position of the accused"
    Unfúkingbelievable:mad:

As I was saying in another thread, the bastard should have been left to fester and rot for the remainder of his disease ridden days in some forgotten dungeon of Arbour Hill.

    EDIT:

And that excuse for a judge should be fúcked into the cell beside him.

Isn't it wonderful to get that level of consideration.

The time has come for minimum mandatory custodial sentencing for rape and sexual abuse.

Too many judges are simply out-of-touch clowns when it comes to sentencing for sex/abuse crimes.

Our wee country is steadily disappearing down the sewer it seems.

Bastard should have been castrated without anaesthetic.

I'm confused about the bail pending appeal. He pleaded guilty. Am I missing something here

What's worse is that the Prison Service had told the court that his illness could be managed behind bars, yet the judge ignored it.

    The disgraceful Justice Carney.

    Again.

Listening to that poor woman on the news.

She's been seriously let down by the so called justice system we have.

Surely the DPP need to speak up. This is essentially a deterrent to reporting or attempting to proceeded with rape cases.

Have to say if I were related to that poor woman, that sentence was the signal to dish out proper justice.

Sadly, these things don't shock me anymore. Ireland surely must be one of the top Western countries where you can rape women and get away with it so easily? :(

I'm sorry but why does someone's age and health come into crimes? This man deserves to die in prison for what he did to his poor daughter. If someone commits a crime and is sentenced to prison they should ****ing go and not get to walk free because they are old. What does that have to with anything.

This country is a ****ing disgrace, why would anyone who has been the victim of sexual assault, rape or abuse come forward when they are treated like this. It must take an unbelievable ammount of courage to come forward then only to get a slap in the face from a sentence like this. I swear the judicial system is nothing but a bunch of pedophile and rapist sympathisers, still after all we have been through in this country this is treated as a petty crime, for once I would like to see one if these yokes get exactly what hey deserve. For shame!

God I hate being a woman some times. Between Savita, the gang rape in India, this instance etc etc etc it's really very hard to not take a disliking to men in general***

Firstly, this poor woman gave up her right to anonymity so that he would be named and shamed.

So, when Justice Carney suspended the last 9 years of a 12 year sentence, that must have felt sickening beyond comprehension.

Then for him to let him walk free pending an appeal? How must that poor girl be feeling right now? According to the article she and the rest of her family were visibly upset in the court. I'd wager that that is somewhat of an understatement.

It started when she was 7. Just 7 years old. The bastard.

Carney should be taken out of the courts with his record of sentencing. I actually sometimes think he may be mentally ill or just evil. Not sure which.

I'll never understand why a person's age comes into it- we don't take away Nobel Peace prizes or any other accolades when someone becomes old or frail, the same should apply to punishments.

Being old doesn't undo the terrible things that man did.

Section 4(a) rape can only be committed by a man, against either a man or a woman.

I think what Curlzy is getting at (and I'm open to correction) is that there's been a spate of stories in recent weeks where women have been abused or had some terrible wrong done to them.

I agree, it's terrifying and makes me thank my lucky stars.

But 99% of men were also horrified at hearing the same news stories, it's unfair to hold it against the entire gender.

That's a stupid point IMO. Firstly you don't know people's gender based on usernames. Secondly some men expressing disgust doesn't negate the fact that most sex crimes are perpetrated by men against women.

Not all men are bad, I didn't say they were, what I said was that it's really hard not to take a disliking to men in general based on all horrific things men have done lately.

    This.

I think it's difficult for men to understand how depressing it is to not be taken seriously in so many aspects of society in comparisan to men, to not have rights to their own bodies, to be under threat of rape and sexual assault and then in 9 times out of 10 not have justice done for it...and the list goes on.

I am not denying that there are many ways in which it is difficult to be a man (fathers rights comes to mind here) and I am not denying that sexual assault and rape does happen to men, but particularly in the last few months, as Lollipop said, so many stories come to light about horrible things women have to go through that just make it overwhelming.

But for someone to say this makes them inherently dislike men in general is absurd.

I feel kinda bad for you if the recent news stories colour your opinion of men in general.

Like, I've had my fair share of run-ins with assholes in my life (hell, I'm going through a break up right now) but I still love and respect the other men in my life, as they're decent human beings who treat women properly.

Maximum 10 years in prison compared to life in prison for rape

A stupid point? Really? I've been around here long enough to know the gender of A LOT of posters. I've been here 9 years.

Besides that, you're being ridiculous and I think you're starting to realise that yourself now because you're bactracking slightly. Even if you're not, it's still an illogical stance to take.

Yes most sex crimes are committed by men against women. But they are not happening left, right and centre. For example, India has one fifth of World's population - 1.3 billion! That's one case in a massive country. Add to that increased communicaions links, media, internet etc and you'll realise that similar rape cases probably happened before but we didn't hear about it because the internet was not as well utilised back then. Anyway, it's the other side of the world!

And to even suggest that there's justification for disliking men, even in general, is frankly ludicrous.

Are you you going to stay away from your brothers and father from now on?

  • Registered Users, Registered Users 2 Posts: 3,272 ✭✭✭Barna77

ffs, fail to pay a fine or the tv licence and you'de be shítting yourself waiting for some sentence or whatever, and then you see cases likes this.

    a fúcking disgrace

And I still wonder why there are constantly so many similar stories in this country. I mean sexual abuse within the family. I read a couple of weeks ago the story about the Dalkey case.... -shudders-
    It baffles me.

  • Registered Users, Registered Users 2 Posts: 730 ✭✭✭wicorthered

I wonder why we bother with trials some times. They seem like a PR exercise for the state.

They pretend they are looking for justice, then hand out mickey mouse sentences for serious crimes. I'm surprised the judge didn't offer the monster a chance to simply pay his way out of this, that seems to be the usual easy way out for rapists!

I hope Paul Carney sleeps well tonight.

Yet another day when I'm ashamed to be Irish!! Having a lot of those the last 3 years!!!

The list goes on, really? I'd like to see this list. And men are more likely to be physically assaulted or murdered but I don't go around saying I'm under threat of physical assault or murder.

Holy mother of fúck I've seen people hijack threads in the past as to use as a platform for their own agendas but you are really taking liberties with this one.

Up till your first post here you were the only person who hasn't expressed their disgust about the judges decision.

More interested in taking the discussion off topic to highlight your own feminist agenda.
