    So there and empty house next to ous that has never been lived in and the oil tank is full.

    What I want to you is you consider it stealing by tanking oil from that tank.
    I seen a neighbour do it one night.

    OP are you seriously asking if taking something that belongs to someone else, eithout the owners permission, is stealing?

    If you take something that doesn't belong to you it's stealing the fact that nobody lives in the house is irrelevant.

    The house has been up for sale for more than 5yrs. The owner is living in England and is never seen around. There's talk of the bank taking it as he cant pay them back. Was talking to the local auctioneer that is selling the house.

    Unless they are borrowing it and intend to replace it it's stealing. The reason the owners have the oil is to keep the house from getting damp.

    Well personally i don't steal from the average Joe.......... however i do have a rule for these types of things! i think it acceptable to take from banks, the government and insurance companies because the simple fact is these institutions steal from me and everybody else on a daily basis...... my eyes are open so to speak!

    Petrol goes off over time. Diesel technically doesn't but if there's any air in the tank you'll get bacteria growing inside it and if you're syphoning off the fuel you'll suck up that too. Could well fcuk up your bolier!

    If no one has lived there for a long time then take it if you're in a tight spot, maybe put a thank you note or an iou on the tank.

    If thats the case, what about countries that have built up oil reserves?
    They must be treating their oil in some way then!

    Firstly, are you able to download this tank of oil?

    If Yes, has this tank of oil been copyrighted?

    If No, then it's not stealing. If Yes, then it is.

    Or such is my understanding of the law as it stands.

    If you move into the house and remain in residence for 12 years without paying rent, you will be able to claim adverse possession. Then the oil will be yours, nice and legal.
