Yes but the police are believing the testimony of someone who said they saw them at 12.

    It's still an alibi

If i'm accused of a crime in Donegal and I say no I didn't do that because I was in Dublin all night and then the police say no you were in Waterford all night and we have a witness to prove it....

Yep i'm lying to the police but it's still an alibi!!

Why did they call someone as a witness who contradicted what they believed? It's because they were desperate!

His DNA was also found all over the crime scene, despite not living there.

Knoxs DNA was found on the knife that killed her, his wasnt

That knife didn't kill her and yes her DNA was on it because it was taken from her boyfriends house.

The prosecution also allege that she carried the 30cm knife around in her bag for days before that........yep because people always carry massive knives around with them

It wasn't valid because she wasn't read her rights, she was intimidated into signing it and she didn't have an interpreter.

I don't know if Rudy confessed to someone or not but in his case all the DNA evidence points towards him.

The defamation charge was upheld though and despite all of the above she had no problem pointing the finger at an innocent man and saying she was at the house. Strange behavior when you consider there wasn't a gun pointed at her head.

But as I said before, there is no denying that the police made a right mess of this. Embarrassing for them more than anything.

Which begs the obvous question whay were the initial jury thinking?

They were thinking she was guilty and that the evidence presented was enough to proved her guilty beyond a reasonable doubt. A key point in the first trial is the defense asked for independent experts to study the DNA results and this was not allowed.
If you read the full report from the first trial, you can either conclude that they had to be involved or that it is a fantasy dreamed up by a deranged prosecutor to show they were involved. For evidence of the latter, read the "Monster of Florence" case where Magnini was convinced the perpetrators (at least 20) were a satanic sect who were collecting body parts for their rituals. He accused several innocent people in that case too, and had been convicted and sentenced for abuse of power. The fact he was involved in the courtroom during this appeal is interesting, given he himself is currently appealing a conviction (but noticably is not in prison). He was even allowed take a leading role in the appeal, something that should not have happened given the appeal had a separate court appointed prosector. There is speculation no sane prosector wanted anything to do with this and they were happy to see Mangini take the lead and lose.

Are you trying to say it's not?

The police call a witness who they say verify that Amanda was not at her boyfriends house.

They say this is a credible witness.

This witnesses evidence (if he is to be believed) proves that although they lied and weren't at home, they could not have committed the crime.

No police in any country would do that, wake up

What motive had she for lying about everything she done that night?

That knife didn't kill her. It was just a random kitchen knife Knox had used for cooking. It was found in her boyfriend's apartment. None of Knox's DNA was found at the crime scene.

The police pressured her to sign statements written in Italian which she didn't understand.

The police made a mess of everything else, so I'm prepared to believe they made a mess of that too. In fact we know they did because the confessions were not recorded.

Just read this: it explains everything:

Why do you think she is guilty? All the evidence points towards her being innocent.

Yes she was found guilty of defamation and righty so.

So minute as to be barely traceable in the original case. Then later ruled too insubstantial/unreliable to meet forensic standards of evidence. Mind you this is a household implement and it wouldn't be unusual to find DNA of all residents on the knife. Similar scenario for the scant traces of Sollecito's DNA that were alleged to be on the bra clasp. Yet Guede's DNA was all over the room where the assault occurred whilst Sollecito and Knox magically managed to not leave any. How did they manage to expertly clean up that and still leave Guede's strewn all over Meredith and the room? That's not just implausible it's impossible.

No worries. If you don't want to know what's going on around you that's entirely your choice. It would be nice though if you were slightly more respectful of others choices and not so quick to dismiss them as crap.

    Thanks.

This made me laugh! The same person has been bickering with somebody else and ridiculing them for using Wiki as a source! Could you maybe respect their choice if that's the case?

The way that DNA was being passed from one item to another was down to the Police and there poor methods. I think they both had something to do with it, but the Police are the one's that have left the Kercher family searching for answers again. This is very poor form from the Italians imo..

Yes she was found guilty of defamation and righty so.

"Rightly so" based on what the jury heard (police testimony) and saw (her hadwritten note) in the defamation case which was the illegally obtained "confession". Nobody can tell what was said that night as it is she said/they said, my reading of her note suggests someone who was shredded psychologically. Many experts in interrogation techniques have said any normal person would say anything to get out of that situation.

There is no doubt Lumumba was wronged, but in my view he was wronged by the police and prosecutor who were desperate to solve the case.

The Kercher family (for whom my heart bleeds, they suffered the greatest loss in this case) have to only look at the profile of and overwhelming evidence against Rudy Guede for their answers. In my opinion thay have been cruelly strung along by a crazed prosector and their own attorney. It was their attorney who displayed graphic naked pictures of the victim to a packed courtroom even though the jury had already seen these away from the courtroom. It was Lumumba's attorney who called Knox a "she devil" driven crazy by sex. These two attorneys were by far the most outrageous in their accusations and actions as the appeal neared the end. They appeared to be getting desperate, I wonder why?

All i've read is that rolling stone article.

Is it a pile of tripe?
Any articles which detail the other side of the coin - ie evidence for them having committed the murder?

On the basis of that article alone it seems like she was innocent, i'm open to reading something to sway me otherwise though.

Yep, i agree 100%, the way that the Kurcher family have been strung along is an utter disgrace. For what happend and the way they have handled themselves through the whole case, i think they deserved better than what they have been served up from the Italian system.

Speaking of crazed prosecutor, been reading up on the Monster of Florence case there and Guiliani Mignini and Michele Giuttari's handling of it. After reading up on it, it doesn't surprise me at all the claims Knox had about the interrogation/questioning.

Either way it's a completely botched police investigation.
