That, or else ring the gardai. Its a disgrace, over in America you can kill them or else severely injure them without a fuss.

If some scummer breaks into my place I won't hold back, i'll be onto him like a ton of bricks.

I thought that law was changed to allow you to protect yourself as you see fit?

Go for it, not a chance the type of person who'd break into you house would even consider bringing a knife along for the fun. :-)

Seriously though, I don't know what I'd do, but I'd like to know I'd have the law on my side!

Really? Wouldn't you be worried that he'd get you at some point?

House got broken into by scummers and attacking them is the last thing on your mind when there's a knife to your neck and their friend has a hurl and stick wit nails behind him. We moved out that night in case they'd ever see us again and I hate being around that area.. If you attacked them and then still lived there, you'd never sleep easy.

Years ago I was told that if someone breaks into your house try your best to get them upstairs - then you can beat the living hell out of them.... (once it's upstairs not on the stairs) I don't know why by the way.

You have to scream 'He's coming right for us' before you attack him. Legal loophole.

The trick is to make sure the burglar is a traveler.

Then you can shoot him in the back like a dog to widespread public acclaim.

Is there bonus points if one reloads? ;)

Seriously though, if I though my family was at risk, I'd do no more or less than anyone would do, to protect their family.

I caught someone in my house one night. About 4am, he was in my kitchen where I was parking my new moped form of motorised transportation, I was still up so I heard a door squeaking slowly. Walked out of the living room to come face to face with a local scumbag. He had my moped helmet in his hand and just turned and bolted out the back door. Before I could really think, I ran out the front wall, jumped the wall and chased him. Was almost catching him when he threw down the helmet. I stopped and picked it up and walked back home.

Looking back it was a stupid thing to do but you never know how you'd react until it happens. I'm glad I didn't catch him, i'm not the fighting type and people that are willing to break into your house are probably more willing to stab me than I am willing to punch them.

I thought the rule was something along the lines of... if the burglar has an escape route (eg. door is behind him) and chooses to advance on you, then you've every right to defend yourself with "reasonable" force.

But if you were blocking the door, stopping his escape that couldn't be proven
that he was trying to attack you instead of simply trying to escape.

Also if they are making their escape, eg. running down the stairs then you can't necessarily giving them a flying kick launching them through the front door window.

Basically, treat burglars the way you would a wild animal trapped in your house.

You can't seriously injure or kill someone over a new LCD TV, even though it would satisfy a primal urge of territoriality.

I'd be very very cagey about tackling a burglar after a break in.

Just over two weeks my house was broken into, along with my next door neighbour.

Both of us had bedrooms ransacked as the scum were looking for money or jewellery etc, but the scary thing was that in my neighbours, the scum had taken two carving knives from his kitchen and had hidden them in both bedrooms, presumably to defend themselves if he had come back and disturbed them.

As far as I know, if you feel reasonably threatened, you can take action to defend yourself from any would be attacker in your home, but I'm open to correction on that one.

I'd call the Gards, and wait if it happened to me, end of story.

i would be very carefull how i handle things, a few years ago i was attacked in my home by a 15 year old neighbour. now this kid was big, same size as me ffs. and i have health problems. so it was all i could do to hold him off and pin him against the wall.
he refused to leave and in the end the gardi came out and escorted him outside. i was left with brusing but he was unmarked. i had to wait 3 weeks for the garda to report back that they will not be proscuting ME for assaulting a minor.
i still belive they were BSing me to avoid paperwork but who can take a chance these days?

    My house, my rules.
Depends if the nipper was in the house or not.
If so, I'll take my chances in court and the intruder can take theirs in hell.
If not, I'd merely maim them.

Throw a tea towel over their head and try get them under the laundry basket?

Or lure them with chocolate and ham, then break their spines in a trap?

Someone coming towards you - You can kill, as long as you feel your life is in danger.

If they are in your bedroom (not anywhere upstairs) (even getting out the window) Kill Kill Kill.

Walking / running away from you - Cant do anything.

Myself and my father tackled 2 fellas years ago trying to break into our pub - Stupid idea looking back, all we had was a snooker cue and had we of known who it was at the time we would never have ventured outside.

Since then we have been robbed once - luckily my parents were not in their regular bedroom due to renovations, if they had been they would have heard the alarm, and we now have loaded shotguns at the ready, Had we heard the alarm that night I have no doubt that 2 stupid young fellas would be dead right now - never caught them but they looked like teens on cctv - When he alarm goes off, We are locked and loaded, but I shudder to think of the consequences of what would have happened that night had we went down.

Im honestly happy we didnt catch them!

Happened my friends uncle a few years ago. Burglar broke in to his house out the country and woke him up. Friends uncle came downstairs like a bull and the burglar shít himself and told him he can't touch him or he'd sue.

"Oh, I wont go near ya, here, let me open the door for ya."

My friends uncle waited a few minutes and followed him down the road and pulled him in to a ditch and gave him the beating of his life. :pac:

I think most people have a "plan of action" made up in their head about what would happen in the event of a thief entering their home.

Personally, if a thief came into my home and remained down stairs I wouldn't bother going down, I'd ring the garda.

BUT! I have an attic room, if it came around that the thief decided to make his way upstairs then I wouldn't think twice about self defence.

I'd like to think that if I heard footsteps at the attic stairs, I'd pick up my 150W Marshall amplifier, prop it on the edge of the bannister and wait, if he decides to make his/her way up...all 25kg of amp will land on their head.

I don't see how self defence isn't an acceptable legal defence here? Surely if someone comes at you (either truthfully or not) you have a right to defend yourself?

(I should probably know this as an ex law student)

  • Closed Accounts Posts: 8,399 ✭✭✭Bonito

My view of self defence is if anybody approaches you in an aggressive manner you drop them. I wouldn't be waiting for some hot headed fúcker to swing before I acted.

Nah, the trick is to make sure that the burglar is a traveller with a long and comprehensive record of violent crimes and burglaries. THEN you'll get widespread public acclaim. :)

my plan of action is to slip into my priest costume, minus the trousers and invite them upstairs to see my valuable stamp collection...it usually causes intruders to reconsider.

Well that's my point. It's your word against someone who broke into your gaff. On paper I would imagine it's fairly open and shut? What judge/jury in their right mind would convict you based on the account of someone who was mid-burglary?

I think it would come down to whether there was use of excessive force. i.e. If you roughed him up a little you're probably fine, and only now have to worry about him/his mates turning up again some night. If however you vegetabalise him after he's unconscious or somethin; Then you're likely fooked.

Rationally, I'd kike to say a knife in the throat before he even knows I'm there. Scumbag pals would be used to running when they see someone hurt.

I know a guy who caught someone in his house, the first question the Garda asks the owner: Did you harm him??

I suppose if you decide to act with force you better make sure you kill him/her.

This really freaks me out! I mean, if someone is on your property in your home or trying to get into your home uninvited and you dont know them then you should be allowed do whatever to protect yourself and your loved ones.
Its like the ridiculous case a few years ago with the traveller breaking in to a guys house, the guy shoots him in defence, and he gets prosecuted?!
I could go on lol , Sophie Lancaster being beaten up and killed by a bunch of scum for no reason other than being called Goth/mosher/or whatever, and yet some scanger who sniffs something up her nose is seen as a tragic accident!

To which the correct response is "No guard, he was like that when I found him".

My plan of action involves me locking the bedroom door (with me inside it), sitting with my back to the door, sobbing like a girl while calling the police.

Oh, my Walter Mitty answer is that I'd used my sekrit spy ninja skillz and leap down at them from the ceiling behind a door, then throttling them with their own shoelaces. At the same time I'd also be looking rather stunning in a figure hugging outfit.

In the real world my answer still holds. Also, the figure hugging outfit might have a cloak.
