Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

    Without making outright predictions but, to the extent these things count for much with tort, I would add these three caveats.

    First is that occupiers liability didn't come up in the last two sittings (online and in person for August), which makes it more probable I would think for it to come up in two weeks. It has appeared on 9 of the last 19 sittings I have data for.

    Second is that professional negligence has also been neglected somewhat in recent yeas. Medical or professional negligence (either as an essay or problem question) hasn't appeared since October 2019, whilst pure economic loss (and I don't have specific results on Hedley Byrne liability) hasn't appeared since October 2017.

    Third is that defamation, whilst not appearing on the online August exam, is examined nearly every year (the most frequent of any other specific topic from the sittings I have access to), so I would think this would be a wise one to include for study tbh.

    Obviously, all the above is part speculation and part deciphering random trends—and I'm kinda just posting this under the assumption someone has some form of notes prepared on some or all of these topics already, with it being just a case of what ones you're restricting your focus ahead of cramming. Just thought I'd share given how awful tort is.

    OK so no rough work or printing of the exam paper allowed. What a croc of BS.

    What does that mean for legislation? We still haven't been provided clarity on this.

    They have changed the format of this exam in an attempt to "preserve the integrity of the exam" but in fact by doing so, they have ruined the integrity of the exam and placed an unnecessary burden on students.

    Really disappointed that we can't print the paper. I don't know what their reasoning for this could possibly be.
    Once we print it in view of the webcam and we can hold the paper up to the camera to show that's all we've printed, what could their reason possibly be not to permit this??

    If this is a solely automated recording, rather than an invigilated video call then how will we be able to use our legislation?

    Will I have to flick through every page in front of my webcam, unprompted because I'm not able to be instructed or ask a question because there is nobody there.

    What happens if I need to go to the toilet?

    This whole thing has been a mess of a journey from start to finish since March. The only reason I am sticking with this is because I wasted 4 years getting a pointless law degree and I am sick and tired of getting nothing but abuse working in retail and I want a way out. Especially at a time like this.

    The practice exam section shows how the questions are and you switch between each question. So its not a pdf and it couldn't be downloaded. Have a log in and see it is quite strange.

    I know! The 'integrity' of this exam went out the window a long time ago and they can't keep putting the burden on students, it's not our fault that we're in a pandemic.

    It's bad enough that we have to sit an exam in circumstances where many of us will not be in a quiet environment, and have the added stress of relying on technology/ wifi that we have no control over... now they're not even letting us print the paper or do out rough work which we have done in every exam we've ever sat

    They really can't get anything right, why not just trust us to print the paper, we all have enough on the line sitting these exams that we're not going to do anything stupid or try to cheat

    They couldn't, however, confirm whether we can go to the bathroom or not... that is apparently still in discussion....
    I can't see how they'd get away with not letting us go to the bathroom on an ethical standard... but they don't seem to consider that regardless

    I'm raging with them....been waiting for an appointment for weeks on end, it's on tomorrow and I cancelled it to do this stupid mock exam that's now available for 28 hours!

    Why couldn't they have sat down for a few hours a few weeks or even last week to iron out the creases??!

    Oh thank you :) When I looked at that practice exam originally I just clicked 'next' after each Q, I didn't see the part on the side with the option click back through the questions.

    It's going to be so weird trying to pick our 5 questions at the start that way, so different than what we're used to

    This is another thing they couldn't confirm to me over the phone, the time or length of exam... which is ridiculous at this stage..

    Does any one have any suggestions in terms of what topics to cover for EU ? I'm only starting my prep for EU tomorrow and feeling a little under pressure and don't wanna be second guessing my approach to topics etc. I am going focus on Anullment tomorrow as I heard its a banker question for the exam.

    Institutions / Sources of EU Law
    General Principles
    Direct Effect and MS Liability
    FM Goods
    Judicial Review (always a Q on difficulty of establishing direct and individual concern)
    Competition Law

    I'd say if you do all of those topics you should be covered. They're all nearly always on the exam.

    If you have time, you could also add in: FM Workers/ Citizenship/ Equality
    And then, lastly: FM services/ establishment (they're not too hard, but also not necessary to cover imo).

    does anyone know if there are T&Cs we can read before downloading all this stuff onto our computers for the exam? like people recording us via webcams/how the software acts/where the data is being stored and what its being used for?

    Just spent 600 on a new laptop so this software better not mess with my laptop. Its happened to me before and cost me a year old laptop in the past..

    Also a thought that came into my head now that we know the mock exam is open for 28 hours. I thought the whole point of it was to test to see if the system could handle the numbers? It's not going to have all the users on at once now until the real deal since we'll all be spread out now doing it at different times...

    Just waiting for the inevitable disaster for the first exam.

    Institutions- most of the work here is prep. Try to get good simple notes.
    DE Judicial review are must
    Equality- try to have a general idea how you would answer an essay q - don't forget rights-
    Citzenship and workers need to be done together. Citzenship can be confusing so watch that
    Goods 34 110 and 30. Dont skip one
    Services & est -

    I am not doing competition simply because it is too long- but doing everything else. I think its ok to skip one topic for EU. Competition is the longest in my mannual

    If you skip Citzenship though and its mixed with workers you could be in difficulty

    My bad. think it freaks everyone out. Equality has been up every year since 2015 and is often mixed with rights questions. Totally understand the need to skip topics though. workload is insane. Equality is such an easy topic and you could skip the human personality aspect (debate about extent of this phrase essay only). Just finished covering it and I would say these three cases cover a lot of issues - you could learn in case it came up as a sub issue

    Blascand Moor- two tier system - some categories have a presumption. legislation should be pedigree blind/ colour & gender blind. Must be a legitimate legislative purpose for discrimination
    Louth - need objective evidence for any classification
    DJ- suggests age classification without more will not be discriminatory

    definitely not your notes- I would say - issue with the manuals - sometimes they are cut so much it is hard to see the problems. Ok for most subjects but not for constitutional. I borrowed a constitutional book- don't refer to it much but it helps for this kind of thing.

    Biggest issues in the human personality aspect - leads to less robust protection.
    Second is the fact of the two tier system - some rights are less protected
    Very low protection for age
    Fleming - also a good one for poor disability protection

    just not robust in general - if you do EU - discrimination is strongly protected in relation to any of the freedoms - like literally anything that can in effect discriminate - is not allowed. close to a zero tolerance policy. Doesn't seem to be the same approach for equality in constitutional law

    Yes we have to agree to privacy statements and terms and conditions, what i want to know is how to get that software off my computer after the exams as you give it permission to access camera and mic!

    Browser Permission - What and why?

    Read and change all your data on the websites you visit -This only occurs during an exam and is a method to ensure that test-takers aren't able to infringe academic integrity with the use of third party sites.

    Display notifications - We may display a popup notification while you are in the exam in the case that you navigate away from the exam.

    Modify data you copy and paste - We don't read/collect the contents in the user's clipboard. Instead, during the exam, we replace the clipboard text with our own to prevent exam content distribution.

    Capture content of your screen - This recording setting only runs during the exam and is only visible to exam administrators to review once the exam is submitted. This is used to make sure that no unauthorized online based resources were used during the exam.

    Manage your downloads - Downloads will only be prevented during the exam.

    Identify and eject storage devices - Storage devices are detected and identified during the exam. But we do not eject storage devices.

    Manage your apps, extensions, and themes - We do not manage the themes of your device. But we do manage extensions and applications that may hinder Proctorio from operating properly.

    Just about to download Proctorio.... it's got like 1.5/5 stars on the Google Extension Shop thingy. Really terrible reviews and problems even after completing exams... very reluctant but guess we don't have a choice, right?

    Am I the only one very disturbed by the reviews of the Proctorio software and being asked to show my ID to this crowd? Really not comfortable with this

    I actually think the Better Examinations system is very good, easy to use and has the highlight option plus notepad and sticky notes. I think it's the best option they could have found.

    I just don't like Proctorio.

    Yeah, I've wasted a good amount of time waiting for it to load. I did the whole pre-exam tests at 9:30 just to be sure but I couldn't see the time either when it was on the loading page so I'm not sure was the time ticking away the whole time I was waiting

    Edit: just to add also, I tried to ring the numbers given in the email but seems like everyone is busy

    Seems like there's no word count and the grammarly extension is disabled, I tried to run a spell check with a special button on my keyboard and it threatened to kick me out of the exam

    It is beyond frustrating that they have not allowed us a pen and paper to jot notes, never mind a hard copy of the exam paper. I do not appreciate having to scroll back up to view the problem question as the text box reaches capacity and both no longer fit on the screen. We have never had to take exams like this before, the least the LSI could have done was facilitate the printing off of the paper.

    In addition, for those who have taken and logged off the 'mock exam' already you will have noticed that the word count feature which is available on the practice exam was not available on our exam platform. Did anyone else have this issue? How are we to gauge how much we've written considering you cannot view the whole answer at once and cannot view a word count.

    Also, the page which listed the elements being recorded during the exam included camera feed, audio, computer screen, websites visited, location, identity document...exam environment was crossed off. What does this mean? If they're recording us that surely means anything surrounding us in the camera frame is captured, so is it just alluding to the fact we will not be asked to turn our cameras around to show the room?

    I am baffled. I feel so let down.

    just did the online mock.. only stayed on for 10 minutes to familiarise myself with the tools layout etc I found it ok just a bit strange! my webcam resolution is pretty bad but it passed the camera test so it must be sufficient quality for the exam.. the only thing im worried about is that when showing my ID the camera quality is so bad all the info on my ID is near impossible to make out, you can see my picture but its quite blurry. Does anyone think that this will cause a problem or since the webcam test was passed should it be ok?
