Notice period

    Not sure if I have placed this in the correct section but hoping if someone can give some advice on this :)

    I am currently working in a company, 5 months into my probation period. I was contracting with the company as a limited company prior to accepting a permanent contract with them. However I am now looking to leave the company - however my contract says I must give 3 months notice.
    A lot of people are saying that legally I only need to give a months notice (I am paid on a monthly basis).

    Should I only give one months notice as opposed to the 3 months, is there any chance I can be sued by the company? What laws/regulations govern this?

    Your people are wrong; your notice period has nothing to do with your payment cycle but only length of time at work and signed contract. Depending on the seniority of the position will depend on if you can be sued (very unlikely in reality) but rather than burning bridges I'd have a discussion with them to see if you can come up with something mutually acceptable instead (i.e. shorter notice but you'll help train up a replacement later or similar).

    I suspect your contact will have a reduced notice period during probabtion , find what that is and start the conversation with offering that time period.

    I am with my company almost 18 months, and my probationary period was the first 12. My notice period for those first 12 months was 3 months (12 weeks) and once I passed the year mark it went down to 1 week (according to the law). This is definitely a legitimate legal thing, although I'm sure if you spoke to them about it they would be willing to bend the notice period based on mutual agreement.
