"A PENSIONER has initiated a High Court action against Dunnes Stores claiming she sustained multiple injuries after a bottle of red lemonade ‘exploded’ when it fell off a checkout counter."

[MOD SNIP]Please don't quote full articles.

What do people think?, personally it seems like she is looking for an easy payout, if the bottle fell and landed on her foot fair enough. It says she went for an x-ray but never says it showed any damage from the x-ray.

The bottle was obviously meant for the staff.

I don't think we can discuss on going court cases.

I hate seeing this claims based nature becoming more prevalent.

    Pure greed.

Mr McCartney said she suffered sleepless nights

I laughed reading this. Thinking of her seeing imagines of Sprite, Coke, Pepsi etc. bottles coming after her.

This is pathetic. In what way could it be Dunnes' fault. Sure the customer ahead of her would have put the item on the belt. What do they want instead of a belt? Some sort of hover belt that uses air to suspend the items.

boy.... the High Court!!!!! Hope she has deep pockets and can afford to lose cos those Barristers fees are in La-La Land terriority.

Depends on how agressive the Dunnes Stores insurers are. I expect they are well used to the courts at this stage and would be out to fight this to the the bitter end.

She should have known better than go to checkout number 13. What did she think would happen ?

I'd love to see the security footage of the fall, just to see that half a second when the bottle touches her and she's making her mind up to take a dive like a premier league footballer and make a claim, You could probably nearly see the lightbulb going on in her head

He said Mrs Sheehy fell as a result of being struck.

Mr Justice Michael Hanna was told after being assisted by staff in the store, Mrs Sheehy attended St John’s Hospital where she was x-rayed.

It is the plaintiff’s case that in addition to suffering injuries to her ankle and lower back, she also sustained injuries to her left hand as she had attempted to break her fall after being struck by the bottle of lemonade.

Mr McCartney said she suffered sleepless nights following the incident and that she continues to experience some pain every day

    thanks for link,

the above is a copy and paste from that article of what actually happened, she did get struck by bottle,

Link added to my original comment seems like it hit her, personally I think she fell for a payout I can't imagine it hit her with much force

it doesnt take much to knock over a 72 year old. a bang on the ankle by something that weighs 1.5-2Kg would be enough. If it happened as described then i dont see what the uproar is about.

Do you think a bottle that fell, and spun around 'rather violently' BEFORE striking someone on the ankle is enough to make them fall ??

She was so shaken up they had to wait for her to settle

if they are 72, then yes.

I believed her story when she said she hurt her ankle. Then I got to the part where she also hurt her lower back, and I stopped believing her

Also if they were in a check out queue, her daughter would have been standing behind her...why didn't she catch her?

if she fell over why is it so difficult to believe she hurt her back in the fall?

if they are 72, then yes.

So you believe a bottle, after losing much of its contents and after spinning around can knock over a standing person by striking them ?

    Fair enough so.

She would have been 67 when it happened, I know its still an oldish age but I think she knew what she was doing, as I said if the bottle fell and landed on her foot then by all means bring it to court but this seems like she is looking for an easy payday
