I just sold my car and I'm worried something's not right

Not sure if this is the right place to post it.

Firstly, I admit that I should have looked further into the procedures before putting the car up on donedeal but it was a last minute decision to sell it off and this man called me within the first hour.

I meet this guy in a tesco car park. Long story short, the car developed a weird problem all of a sudden after the test drive. At this stage I'm just looking to get rid of it, he offers me a low price I end up accepting. He says that he's a registered motor dealer, gives me name, address and garage code. He gets me to sign and put in date on one part of the vehicle licencing cert and tells me as a motor dealer, he needs to take the whole cert. He says he'll fill the rest out and send it on. I wasn't too sure about that but he says as a motor dealer that's the procedure and that I don't have to do anything else. He says he's literally going to strip the car for parts as the motor is now busted. It was his intention to do so anyway. (I did drive it around myself after and there was definitely something not right with it, never had the problem before though). I get the cash, he drives off and heads home.

I still feel something wasn't right so I check online and it seems we should have filled out a form called RF105 with both our signatures. I'm very worried now that the car will remain in my name and god knows what it will be used for. I tried calling him but it rings out. What are my options now? Should I be contacting someone about this?

Did he have a root around the engine before the fault appeared?

Keep an eye on donedeal. The car may magically fix itself again

He was with his little daughter who climbed aboard the passenger side, he said he'd drive around the parking lot very quickly. So I didn't think to get in as his wife was in their car next to us. I assumed he'd drive just in the lot where I can see. But he was gone a few mins though. So yes he definitely could have. At this stage I'm just worried the car will not be changed from my name and I'll be liable for whatever.

Yes there is a form for transfer to a motor dealer and he must have a dealer number in order to fill that out and be classed as a motor dealer.

It appears you didnt fill this, he simple talked his way into getting you to hand over the log book.... You have been had.

Secondly, car developed a strange fault during viewing. Is it possible he manufactured this fault? To suggest that a fault meaning the engine was toast suddenly occurred yet he still wanted the car is odd to say the least.

I think you have been scammed twice in the one transaction.

Expect it on donedeal within the week with a nice profit and no engine fault.

Sounds like you got scammed.

He went off might have disconnected a coil or injector (depending on petrol or diesel) as you go away he fixes it again and its perfect again. Sells for plenty of profit (in your name) or has a nice cheap car for himself.

Also never let anyone drive the car away without you regardless of another person in car next to you as they can dissappear too and bye bye car and no money.

You were done unfortunately.

What details do you have of this fella?

Did you get his number,reg of his car?

If hes a garage have you tried googlein the name of the garage?

Have you put any of the details you got so far in google?

When you say done did you drop the price because of fault or would you have sold it at that price anyway ?

I know, I'm kicking myself for being so gullible. I don't know what I was thinking, it happened so fast and even as it was happening it didn't feel right but I was afraid I'd be stranded with the car having to pay for a tow. Yes, I should have gotten into the car but because it was a 2 door and both himself and his daughter were in it already I didn't, I know that's no excuse at all.

I called the guy there and he answered, I said we have to fill out the RF105 form. He agreed to meet up tomorrow to do that. If he doesn't show up to do this tomorrow, I should be contacting the guards right? The last thing I want is my name on a car that might up getting fined or at worst be used to commit offenses.

Is there a way of checking the garage code online? His name and the name of the town doesn't yield any results.

I initially said I wouldn't go below 500. He said 400 on the phone but he said he'll take a look and see, I assumed I could get him up to 500. Then after the fault, he said 250 and brought it up to 300 after I said 400. I was just pissed the car gave up on me at the most crucial moment so I accepted

Yeah the car was a failed NCT. I was just looking to get rid of it full stop. The local garage was giving me like 150quid for it so anything higher was a plus. Yes, I just need my name off it. Are there ways to do this without the cooperation of this guy, in the worst case scenario that he doesn't respond tomorrow?

If he exclusively uses donedeal it won't show.

One thing you can do is get a replacement VLC, and sign it into his name. Not exactly legal though.

Stop worrying. If he doesn't show, off down to your local Garda Station with you, explain the situation and they'll see you right.

In the meantime you should pop in to the guards. Explain everything & they'll make a note of it. At least from that moment on you have a chance of not paying any parking fines, speeding fines, m50 tolls etc.

Yeah, the name transfer is the only thing I'm worried about really. If worse comes to worst and he's a no-show tomorrow, I'll pop into the guards. If the guards can help me get the name off it, I'll be happy.

I had to go to a solicitor/peace commissioner and make a declaration that i no longer owned a vehicle when the parking fines started arriving some years ago .. after selling a mark 2 golf

OP you can ring the vehicle licencing lads in Shannon and they will send you out a form saying you have no claim on the car anymore. You get a comissioner for oaths to sign it (they charge you about a tenner) and send it back.

Dont worry this is not the end of the world.

If he reports it to the garda today then at a later date he can argue with m50 tolls. He'll have a record from the garda saying he didn't own the car. The toll company are pretty much ok in genuine cases like this. The same as the garda are good about it.

The Gardai might not be able to assist with toll charges directly, however if you were to dispute the charges on the basis of the car no longer being in your possession then it cant hurt to have it on record that you have reported the incident to the Gardai on a particular date.

I popped into the guards last night but they didn't take any formal notes, just advised me to contact vehicle registration in Clare. I've notified vehicle registration this morning and they're sending me that form declaring I'm no longer in possession of the car. They also confirmed me to that his "garage code" was not genuine. Anyway, I'll get that stamped by the local piece commissioner here and send it off. Should I be contacting the guards again and requesting them to make note of it?

You could make a formal complaint that feel you have been a victim of fraud. No idea what the Gardai can/will do about it, but it cant hurt I guess.

There's an option when you post to get a confirmation of receipt, it's different to registering it, make sure you ask for this when posting off the form to Clare. The actual process is posted in Consumer Issues.

The process is posted in consumer issues on the transport.gov.ie website is it?
