Habitual residence and my movement around

    Hi all,

    Just wanted to ask a quick question.

    I am 27 and lived in Ireland until I was 24 (born in Ireland). When I finished college I moved to the UK. (just over 3 years ago). I worked there for 18 months, then left to travel Asia for 2 months. When I returned, I came back to Ireland and signed on. I couldn't find a job in either Ireland or the UK and remained on JSA for 9 months. I eventually found another job in the UK (this was last August). I worked in that job 8 months but unfortunately last week I was made redundant :( I am now looking at coming home again. Can you please tell me if I will be entitled to sign on given that I worked in the UK in between signing on before and signing on now? I am worried about habitual residency affecting me when it comes to this. I would sign on in the UK but I am living in London and the Jobseekers pay is so low here I wouldn't even manage to cover my rent never mind food and transport so I have no choice but to move home.

    Would you not consider moving somewhere else (read cheaper cost of living) in the UK to work? I know of Eng jobs in western Germany (cheaper everything compared to London) you could walk into tomorrow if you were interested. Much better than going back to Ireland IMO

    You'll be assessed for JSA which is means-tested, rather than JSB which isn't. You also have to prove you've cut all ties with the UK. Ferry/plane tickets; proof you've given up your home, closed your bank a/c and so on. Bring your P45 & P60 as proof you've been paying tax and stamp in the UK (don't lie about this, as Welfare will check with the DWP in Newcastle! :))

    Having said that, you'll probably be better off staying in the Smoke TBH. You'll have a FAR better chance of getting work there. The jam roll there is the pits, I agree. But don't forget - you can get medical treatment for free; dental treatment for free, and the rent paid if you apply for Housing Benefit. You won't get that here - you still have to pay something. Neither will it be a given that you'll get either a Medical Card or RA until you've been here for some time.

    habitual residence rules have been tightened up greatly. you need to be well prepared in advance for that. it is possible still to get interim assistance, ie emergency, from a cwo so not all black

    You will have no problem with habitual residence. Just make sure you have your P45 from UK and proof of termination of lease. If you are in receipt of jobseekers or other sw payment in UK then make sure you also have a letter from DWP stating you are no longer in payment. When you come back to be sure and get your contributions you have paid in UK over the years transferred to Ireland.
