If he said that and people had to take responsibility for themselves.... a lot of people would be out of jobs.

Lawyers, court reporters, judges, it would be a total nightmare and society would come to a halt. Can you just imagine giving people personnel responsibility. *shudder* perish the thought.

We don't make anything in this country, we don't really do anything useful (well a couple of big foreign companies that employ lots of foreigners do)

but why bother? Bureaucracy and the law can give everyone cushy jobs

PTSD? From slipping on a few steps? While loss of earnings is a legitimate claim, one would have to ask whether the plaintiff is capable of working in another capacity than that of her chosen profession and limit the award accordingly...

This one is just ludicrous, judging by her surname, the woman comes from a subset of society well-known for their part in insurance scams and has a history of making a similar claim in the past. Nevermind the fact that the engineers evidence cast her testimony into disrepute. Ludicrous stuff but one has to commend her insurers for at least trying to take it to court instead of the usual "settle on the steps" stuff.

I think that's very unfair personally. We know you were an excellent physiotherapist but you can't do that any more. Sure we'll chuck you a few bob and you can work in a call centre instead.

I'll admit the PTSD always raises eyebrows with me but anxiety etc has probably been caused by her employment and financial situation as a result of her accident.

I think the thing to do here is that everybody go out and do something stupid like the op. It will quickly become apparent that something has to change.

But for the installation of steps the Council would not be liable. But for the lack of a handrail this incident would not have happened. Whoever was in charge of maintaining the public beach has a duty to maintain it properly. It seems a fairly obvious hazard that could easily have been fixed.

May I suggest the Goodyear blimp fly over Ireland with a giant flashing sign saying "everything is dangerous and should never be attempted by anyone ever"

I'm going to sue for damage to my neck when I look up at it.

nothing more than pure ****ing greed - I swim most days , I take the risk , sometimes its slippy , sometimes its dangerous , but I take the risk, its my responsibility - not the council - this case is everything thats wrong with irish society - ****ing GREED - the water is a public amenity to be enjoyed by all - life is full of risks - more cases like this and Councils will be forced to ban swimming for everyone so as to reduce its exposure to the greed of cases like this and his high moral legal team.

People should have the expensive option of 'dumb stupid and careless insurance' to cover these incidents....take it out if they wish... if not just fuxk off.

She knew the steps were icey. To be honest it was her own fault so she shouldn't have got anything. Same with the idiot in the OP.

At this rate of going, the guy in the infamous RTE footage slipping on icy footpath has a clear cut case.

Obviously a nasty injury, but does personal responsibility not exist anymore? It says Dublin City Council should have cleared the steps of seaweed, or installed a handrail. But they weren't there, but this guy still went ahead and used the facilities anyway. There's one person responsible for this injuries, and that's the guy himself.
The judge should have said "tough shít, you fell. Next case"

SHOCKER: Seawater makes sh1t slippy.

In other news, lemons are sour.

Be careful out there folks.

Really pissed me off this one . She had a similar claim 14 years ago but couldn't remember it . I mean wtf who could forget it . Thrown out with costs against her which no one would pay. But judge gives her 16k and encourages more claims for the legal profession

maybe she got knocked on the head which affects her memory? ;)

I'm suprised the judge didn't compensate her for missing the sales

Ireland, lots of law but no justice...

It would be cheaper for councils to close off these facilities rather than keep up the pretense of maintaining them, or stick up 'no liability' signs like you get in car parks if your car gets robbed.
There not even facilities as such, it's just the natural world. All towns and cities should have bg walls put around then so that the people inside won't get attacked by the natural world and can be protected from the laws of physics.

Yes. I;'ve said as much. So she has contributed to her own accident which was why the award ws reduced. The fault still lies with her employers for failing to clear the steps.
