3 wks ago got arrested on the street one nite for affray but was released after an hour and not charged....a girl hit me 3\4 times and then bite my finger as I wrestled her to the ground to get her to stop the gardai came and arrested me.

She now claims I swang a bag of ice at her, punched her and then we scuffled on the ground till gardai arrived.

Now I have been asked to give a statement. Facing a possible section 2 or 3 the gardai says.... No previous.

What are the chances of an adult caution and if not what could I expect

    We can't say.

If you are being accused of a crime, you risk a conviction, which can have adverse effects. If you are being asked to make a statement, do consider talking to a solicitor first.

Write everything down now, before your memory fades. Give that to your solicitor.

That's the best bit of advice you will get. Write down your account of everything this minute and include everything you can recall. You will be amazed, even a couple of months from now you will re-read your own account and realise how your recollection has changed.

Get a solicitor, have some nights in.

I have gor a solr. but I am just wondering what peoples previous experience of such allegations are and how was it persued by the garda.

Writing down memories of the event Is certaintly a good piece of advice has it could be 12 - 18 months before a trial

Its an awful experience to go through so thanks for any input

Any CCTV around where it happened, you'd want to move quickly to check, it usually gets copied over every 30 days or less.

Might be useful getting copies of the CCTV yourself under the Data Protection Act, rather than waiting on the Garda to interpret what they see, you would be able to view it yourself.
