Lumia 800 - Can it be unlocked?

Hello - Have a Lumia 800 which my mother got on contract from emobile and gave to me as she cant use it. I want to use it on another network but emobile will not give me the unlock code Is there any way to unlock these phones?

Was the phone paid in full or is it still under contract? If it was paid for I would think the unlock code should be provided. Else there are a number of online options to get an unlock code but these are not free.
