Can I claim VAT on commercial rent?

    Hi. I'm VAT registered and rent an office in Dublin for €400pm all in. I asked the Landlord what rate of VAT I should claim back and he said he is not VAT registered, so VAT is not in the rent. I took him at his word and just put the rent as expenses, no VAT claimed back. I have been there about 2 years and VAT registered about a year now. A colleague of mine said I should be claiming back VAT off the rent. I'm confused now.

    There are a dozen offices being rented at the location with average rent of maybe €600 per room (if that makes any difference). The landlord is a sound chap and don't think he is being malicious, or anything. Can someone help?

    Like I said, rent is €400 a month. I am there 2 years and only VAT registered 1 year. I have not claimed any VAT on rent. If I should be, how do I claim lost VAT, which would be hundreds of euro now. I assume the rate is 23% for commercial rent??? Thanks all in advance.

    The rule with VAT is that if you do not incur it then you can't recover it.

    Don't over think it.

    Yes. Thanks, I know that. How do I know if VAT is not being charged? If the LL is renting a dozen or so offices, is he then not required to charge/pay VAT?

    I just pay him by cash (rarely), or cheque and i never ask for, or receive receipts. I did at first, but my bank account provides me the proof I need that rent is paid

    VAT on property is very complex in general there are situations where VAT is not charged because the landlord has decided not to register.

    So as he originally said there is no VAT, I can take it that there is none to claim back. Thanks for your input.
