i am thinking same as ye guys- i said this weeks ago- out of the golden 5, he's due to dump impact national legal systems (supremacy, direct effect, member state liability, national procedural autonomy) or else FMOP (workers, establishment, services and citizenship) next- i've prepared the golden 5 but i will be sickened if either two of these don't show up tomorrow. In a dream world he would leave out....mergers! Dream paper tomorrow would be institution/SOP q, impact national legal systems, fmog, fmop, competition, prelim rulings, state aid.

Have yet to go over state aid and equality today, head melted again.

Really don't want to have to rely on casenote Q but i guess it is there as a back up- i think the FR chapter really feeds into casenote q so might be worth having a look at cases like Nold, Kadi etc. Citizenship feeds into it too i believe. You can't prepare for it, just hope for best.

I made a really silly mistake today- i turned on some eurovision choons to get me in the mood for all things european after having engrossed myself in all things equitable over weekend AND now i have the Bulgarian entry 'Water' from 2007 stuck in my head- and yes, it's in Bulgarian.

art 102- prob my fave EU law topic actually

I hope hope hope competition q is on 102 because i HATE 101- i dunno why i just have this imagine of men and cigars in this Dallas-type existence plotting to take down the rest of the world- he gave choice last paper 101 or 102, think he will do same this year.

anyways back to Q- 102 easy- undertaking, define market, market share, dominance, abuse, effect on interstate trade- i know you will prob know key cases- Continental Can, Oscar Bronner, United Brands, Hugin, Microsoft, Hoffman la Roche, Virgin/BA, Michelin, Suiker Unie, Tetra Pak etc etc.

    Lacking motivation:
1 exam left on wed - can someone really scare me into working hard now! so sick to death of it - perhaps a thought about repeats.

    -Classifications of Crime

    -Presumption of Innocence
    -Arrest
    -Bail
    -Detention
    -Silence
    -Recklessness

I dont know anything about predictions but I'm covering basically same as you except I left out arrest/bail/detention cos there was a quest on that last year and I covered strict liability and incitement aswell- no particular reason why though! Also in addition to classifications generally, specifically an essay on minor v non minor cos that came up one year and he didnt seem too happy with how it was answered!

Did anyone stay in bewleys hotel newlands Cross? im illurgic to the ibis - and its 58 for a late booking! the view of 15 lanes of traffic drives me mad!
68 for b&b in bewleys - red cow moran is overbooked tonight apparently by 3.

I'm driving from cork this afternoon and back to cork tomorrow at 12:30 if anyone needs a spin! not sure exact time driving up though depends on how much study i can do from home!

Those sausages in the ibis for breakfast have to be the worst sausages i have ever eaten in my life - worst than the cheapest sh*te u could even buy in lidl! unbelievable! I slammed them in the survey dreadful place - depressing!

I know all that, I just can't ever remember the case names, and what case said what. AND I always spend like 5 mions trying to remember how to spell O'Mathghamhna. It always seems to come up as an essay too, I feel there's more leeway in prob Qs if you forget case names etc....maybe that's just wishful thinking though!

Given that definition of a crime was always very popular with the examiner but hasnt come up in a while, I reckon you're mad to leave it out. Same for presumption of innocence.

So for this blasted contract exam I'm covering:
    Offer & Acceptance
    Consideration
    ICLR
    Undue Influence/unconscionable bargain/duress
    Misrep
    Estoppel (promissory)
    Parole evidence rule
    Mistake
    Discharge - breach and frustration
    Privity
    Damages

Will do some bullet point notes on illegal and exemption, just in case

Please god I'll get 5 q's out of them. Can't do anymore, still need to try and remember those damn topics!!

yeah if you know melling well and a few cases surrounding it then it kinda sorts ye for 3 essays questions - can be brought in fully for definition, can be brought in big on a minor v non minor and can be partly brought in on a question on classification..

I have melling covered anyway.. have bail, right to slience and arrest/detetnion too but not really going over it too much as i dont feel it will come up.. then have mens rea covered and presumption of innocence - have to freshen up on those tho.. was gonna go over the courts but them questions can be nasty to remember - legislation and consitution, stupid cases etc.

Of course will be going over offences and defences too, with a brief look at incitement, attempt and stuff like common design and conspiracy.. gonna be a long day! Might stick to my sample answers and notes, don't have a huge amount of sample answers though if anyone wants to send some on!

Does anyone know when the independent lectures get taken down from the site? Is there any way of keeping them, ie recording them. After messing up my exam methods in constitutional , i woukd be shocked if i dont have to repeat the first 3.

God damn Noel Travers- WHERE were FMOG?? and i had such a lovely institutions/democratic deficit/SOP essay in me! Stuck for a fifth- toss between transparency or case note q but went with case note- all the hours i wasted on CDs and CEEs and MEQRs and mandatory requirements and he left them out for second sitting in a row!

at least i have only one more left

hi guys, just wondering as regards ciminal, what essays are people going over?

Also, as regards s.4 rape, does it include penetration by an object into the anus and vagina? think something of the nature was in a 4 part question at the last exam .

S4 rape: penetration of mouth/anus by penis. Or vagina by object (not fingers). Anything else is sexual assault / aggravated s.a. / s2 rape.

When talking about s4 rape do you have to go through all the elements of sexual assault? they do that in one of the griffith sample answers and I'm not really sure why...

Why would you bother when they're two distinct offences? Doubt there's time or need to do that tbh.

  • Registered Users, Registered Users 2 Posts: 1,889 ✭✭✭evercloserunion

Haven't read that Griffith manual but it's possible that they're not talking about sexual assault as an aspect of s4 rape, but rather they're talking about it as a separate and potentially relevant offence. In many problem questions where s4 rape is relevant, sexual assault may also be relevant.

Anyone any tips from any of the colleges what this new examiner is likely to do? Really struggling for motivation in the sunshine.

Ugh I had five attempts but i did not like that paper- started off with prelim ruling q, then i did FMOP question, article 102, the q on Boomtonia and the directive and then the case note question was a rushed affair- just hope there was enough for 50! Would hate to ever have to open the treaties again. How did other people feel about it?

And how appropriate that they set the date for the referendum for the new treaty today- prepare yourselves for another media campaign to say yes, an inevitable no vote and being marginalised even further in the eyes of the French and the Germans...

Great minds think alike! Attempted the exact same q's only didn't get to finish that boomtonia one so now I'm worried, hoping for a miracle!
