    So she wasnt raped.

Ironically, she's never even claimed / alleged that she was.

One thing that leaves me so cynical about stories like these intially is how loose the word "rape" is thrown around, rather than sexual assualt. Almost trivialises such a disgusting and serious topic.

As the situation currently stands, I think this would class better under groping (If he was fondling her without her consent) rather than out-and-out rape.

But, me thinks the media outlets are having a field day with their headlines. Guilty until proven innocent and all that.....

People love the witch hunt I think. Idiots, bandwagoners, sheep, call them what you will :)

There' s a little thing I like to call mandatory rape, it's like the opposite of statutory rape where the state has to prosecute when it learns of the offence, mandatory rape... well you get the idea

Something which most people have done at some stage in their lives.

The 13-year old's video was difficult to get through, what with her facial expressions, amateur psychology (probably googled) perspective and general demeanour.

How dumb horny does someone have to be to commit such a serious crime while under constant television surveillance?

    FYP:)

i agree, but how stupid of any girl to get so drunk in the first place.

    Mod Note: Poster Banned

Funny, seems this banned poster hit the nail on the head. She got so drunk she would have consented to anything. Silly bitch. Nothing to do with rape.

Seriously? This shit again? How do you know she would have consented to anything? How do you know she wasn't so drunk she couldn't consent to anything?

To the men on here, if you woke up after being drunk to find a man had had sex with you while you had passed out, how would you feel? I think alot of men can't comprehend the horror of the situation, as it is not in their realm of understanding i.e something that is not likely to happen to them.

We're assuming the man in question is homosexual and that we know the other man was not drunk, obviously?

Why does that analogy have to be two men? Why not a man and a woman? Plenty of my male friends have done stuff with women when legally they were unable to consent, don't think any of them have said they were raped or sexually assaulted in such cases though.

And you know this how ?

There has been enough crap on this thread in relation the fact that people should have more respect for themselves than to get paralytic or in a state that "they would have consented to anything", but that does not take from the fact that

    a) there's a chance that they still didn't consent, making it rape and still both a horrendous crime and the actions of someone I wouldn't even call a man

    b) you don't know the above

However the FACT of the matter is that she herself said that sex DID NOT OCCUR, and therefore the entire "controversy" is just a sickening PR stunt, and an insult to all actual rape victims.

False, as already pointed out in this thread.

Since rape isn't actually about sex, is that a fair assumption ?

Not arguing, btw, since I "understand" neither a rapist mindset nor homosexuality.......just asking.

I don't understand the whole "rape isn't about sex" line. It's just that for the analogy to work the person you wake up beside would have to be someone you could conceivably have consensual sex with.

to be both is stupid, especially if surrounded by testosterone &/or drink fueled men.
girls need to know this, and to advise/educate them might be far more beneficial than moralizing about who to blame.
if all men could control themselves, then we would not be having this discussion.
Are you guys Muslim Clerics by any chance?

Best play of the racist card .......EVER

In a report published on the O Globo newspaper, Echaniz's mother was quoted as saying that her son is a "victim of racism."

When did it become anyone else's business what I do with my body? If I want to get absolutely S*IT faced I will, and it's noone's business but my own.

That does not give anyone the right to rape me. How can you not see that?

Where have I said it does give someone the right to rape you or any other person. I'm simply pointing out that a victim of a crime who was drunk at the time of the assault would not be considered a viable witness by any prosecutor and any defence lawyer would see to that.

I have already stated rape should be punished to the full extent of he law.

I'd now like you to explain how I have in any of my posts condoned or blamed a victim for getting raped?

No you can't. He's doing your trick of linking one to the other as if they're cause and effect, then saying they're not related. In your case (your post) , it was about what came after the 'but...', in his case, what came after 'however'. Other than that, a pretty similar attitude. 'I don't excuse rape, but she was kinda looking for it being that drunk'. That's what it looks like to the rest of us.

That's totally wrong. I have always stated that a rapist should be brought to juctice. I am simply trying to explain why I think the DPP does not go ahead with prosecutions in many of the cases which were reported. It's not the only reason but I'm sure it's one of a number of reasons.

I also totally resent the implication that you suggest "she was kinda looking for it being drunk" is a view that I hold. It is not.

Ah they don't have a notion about sexual assaults and how they affect people
I just assume because of this forum the sexist crowd and racist crowd are always lurking about.
