HELP!!! ive been sold a catagory A1 write off car and dont know what to do!

    in the morning i will

    1. call quinn again and see if they can give me any more info on how it was written off (guessing i wont get much out of them)

    2. call shannon and see if they can shed any light on the subject

    3. call the garda! see what i can do from there side of things

    4. as the seller is obviously gonna avoid my calls , maybe i should send a text saying what action im going to take if he doesnt reply?

    Also make a quick phonecall to your solicitor, check first, but I'm sure they will offer you some intial advice for no charge.

    If he refuses to talk to you then you may have to take legal action. If you paid by cheque and it has not cleared you can stop it. Otherwise you will have to issue proceedings, remember the car must be a danger.

    Is that the law, i.e. buyer beware in private sale except if it's a danger to the buyer, so what can consitute and danger ? e.g. one baldy tyre ?

    I would doubt it, but the wording is from the 1980 act, as I said earlier you would need a motor assessor to give evidence that the car was a danger to the public.

    It is an offence under both road traffic legislation and the Sale of Goods and Supply of Services Act 1980 to sell a car which is not roadworthy. Also, the seller is required to give you accurate and truthful information in answer to any questions that you ask. However, a private seller does not have to provide information that is not requested. If you have a grievance after buying a car you should complain to the seller first. If you are not satisfied with the response you may be able to take legal action against the seller. Where the car you bought is unroadworthy, you could also refer the matter to the Garda Síochána and the Road Safety Authority.

    Ill update you guys once i get all that done 2moro

    if its a clone car, it has been done seriously well as all the numbers are matching up in all the areas! could be flood damage?? the cost of a replacement engine is gonna be ten times higher than the price of a new passat so maybe the insurance company wrote it off that way...............but then as you have been all saying , a cat a1 is basically a car beyond any repair

    fingers crossed this gets sorted :(

    hoping you guys can help me with as much info as possible

    yesterday i bought a silver 1999 volkswagon passat tdi , had a major look over the car and everything seemed fine , has a 2 year test and 1 months tax on it

    nothing seemed out of the ordinary on it.

    so went to transfer my insurance onto it today (quinn) and they told me the car was a catagory A1 write off (meaning it can not be used on the road and should be crushed or something along those lines)

    FFFUUUUCCCK!!

    tried to call the seller , but he hung up within 5 seconds and turned off his phone (he obviuolsy new about this all along)

    is there anything i can do about this?? like how does this car have a NCT if its a write off???
    ive had a major look over the car and it seems perfect , chassis numbers match , no signs of crash damage etc the car itself is fine!

    what can i do about this? please help , im down money i dont even have :(

    Some private sellers are actually no such thing, and offer cars pretending to be private to avoid tax and the legal implications of being a dealer. If he offered around ten cars for sale, the Small Claims might accept a claim. Did with me.

    So you had no insurance on the car when you drove it home ?
    I thought you had to transfer the insurance before you even picked it up.

    I thought you had to transfer the insurance before you even picked it up.

    How do you know that? How do you know he doesn't have cover to drive under a third parry extension or a friend does and how is that statement relevant?

    HI Guys,

    I work in the salvage ind.

    I highly doubt the vehicle is a cat A as it would be a big melted wreck.

    Cat B is a vehicle sold for scrap cannot be put back out on the road, usually high chassis damage or floodwater damage.

    Cat C is uneconomical to repair ie: Bad accident can be fixed but would cost more than its worth

    Cat D is Repairabel total loss where repair costs do not exceed vehicle value
