    TBH the original sentence was a joke for the seeming nature of the assault. To get extra leniency simply because he at some point in his life he had to a luminous jacket beggars belief.

    The original sentence was very harsh compared to others given in courts.

    Heres more of it...
    A MAN who claimed a number of gardai "beat the crap" out of him was awarded €52,400 in damages by a High Court jury yesterday.

    By a majority of nine to three, the jury found excessive force was used on Michael Turner (40), a fitter and driver from Ballyogan Wood, Carrickmines, Dublin, following his arrest outside a nightclub in Dun Laoghaire, Co Dublin, in August 2002.

    Mr Turner brought the action against the Garda Commissioner and Minister for Justice for assault, battery, false imprisonment and malicious prosecution. The claims were denied.

    His counsel, Mark De Blacam, told the court Mr Turner was on a night out on August 9/10, 2002.

    He met a friend and they went to a bar where he had five or six pints and a cocktail before they went to Nemo's nightclub until around 1.30am or 2am.

    As he was standing at the doorway of the club, he was accosted by a bouncer who told him to "f**king leave".

    He was grabbed by the throat and pushed against a wall.

    A garda van arrived and Mr Turner was handcuffed, lifted by the hands and legs and thrown into the van, counsel said.

    On arrival at Dun Laoghaire garda station, he was dragged from the van, and kicked and punched with one garda leaning on his back, counsel said.

    He was dragged into the station and, when he asked for a doctor, was told "you are getting f**king nothing", counsel said

    He had a laceration to his head and was bleeding profusely. He was later brought to St Michael's Hospital where he received a number of stitches.

    It was alleged that at least one garda used a baton.

    Mr Turner was later charged with a number of public order offences but all were dismissed.

    Under cross examination, Mr Turner accepted he resisted arrest but said it was because he hadn't done anything.

    Garda evidence was that he was kicking and lashing out before being brought into the garda station.

    They claimed he had tumbled to the ground when he was being taken into the station and at that time it was observed there was a cut on his head.

    Was talking to a taxi driver the other night about gardai. he said it best and I would agree:

    ".. meet a gardai on his own off duty he is usually alright... put the uniform on him and watch the power goto his head..."

    gardai are wan*ers and if anyone says otherwise clearly lives in a bubble.

    Any problem I ever had with a guard was caused by me, completely disagree with you. That's not to say all guards are sound but ya get w@nkers in every walk of life

    No its not official Law, but it looks like its one of those that is applied in case of the Garda but not actually on the statute books. An unwritten Law.

    A former garda sergeant who was caught growing cannabis in his home has received a suspended prison sentence at Dundalk Circuit Criminal Court.


    Cannabis leaves were found strung across the yard, drying in the air and a total of 77 plants at various stages of growth were found in several incubation units hidden in a garage and sheds on the premises.

    The court heard that Mr Hickey had served a year in prison at the Curragh after he was convicted of forging passport applications in 2001. Mr Hickey was sentenced to three years imprisonment, however, Judge Michael O'Shea suspended it on condition of good conduct for four years.

    true. you get wan*ers in all walks of life.
    But you get more wan*ers when a job gives someone power. Ie, gardai and bouncers especially.

    maybe "all" is a inaccurate word to use. But certainly majority would be accurate.

    well "prinz" ... why dont you go about your business some more and for gardai to stop you for no reason talking down to you. happens all the time.
    and thats just one example.

    as i said, take the uniform off a gardai. Probably an alright guy. But it on... different story.

    the point is "ex" gardai so my point was/is Gardai. There appears to be a provision in Law for same.

    I know the case, but I still think people are getting worked up over the wrong issue.

    You deserve the patronising bullshit because you're a serial apologist for the Gardai and refuse point blank to listen to reason. It's been pointed out to you on several occasions in this thread that the police officer in question (a) received a custodial sentence for a dreadful assault on a drunken man leaving him with broken teeth, cuts, and serious brain injuries. And, (b) he then effectively walked free from court BECAUSE OF A PROVISION IN LAW THAT APPLIES ONLY TO GARDAI. Yet you deliberately and continually argue, in the face of reason, that his occupation has nothing to do with his sentence, or lack thereof. A pathetic display.

    I have been stopped. It's never been a bad experience. Simple, be polite, be straightforward, be honest... and before you know it you're on your way and they are on theirs.

    There were emotional scenes in court after Judge Ó Donnabháin made his order with Foley's family flooding from the public gallery to embrace him amid tears.

    Yesterday, Foley's mother had collapsed in tears and had to receive medical treatment after Judge Ó Donnabháin imposed the 18-month sentence with 12 months suspended.



    A big fiasco so, Its as if he is a victim. You would swear he was going down for years, Which in essence he should be..

    My apologies for not immediatly critising every Garda that crosses my path.

    Look I'm not defending what this Garda did. I just think people are more worked up about the fact that he's a Garda and got off because of it than about what he did or the fact that such a sentence has the potential to be suspended.
