    I can't wait till he comes back, trust me the people of Cork will never forget this.

    Anytime he decides to go off on one of his self-righteous tangents, someone will just go "pull the other one, Neil" etc etc.

    The Gardai are actually powerless in the matter. The plane & it's passengers were still under the juristiction of British law when the incident happened.

    This is due to some technicality in aviation laws - despite the fact that the plane was on Irish soil.

    There's nothing to stop the police in the UK persuing the matter. However, whether that happens or not is a different issue altogether.

    This is due to some technicality in aviation laws - despite the fact that the plane was on Irish soil.

    There's nothing to stop the police in the UK persuing the matter. However, whether that happens or not is a different issue altogether.

    So the next step will be extra-dicktion!!!

    The radio star was alleged to have first exposed himself and then masturbated while seated in the front row of the Aer Lingus plane en route to Cork.

    Mr Prendeville later insisted that he had absolutely no recollection of the incident after consuming painkillers on top of three pints of Guinness, three bottles of lager and a copious amount of wine.

    He vehemently denied having taken any type of drug such as cocaine -- and said he would undergo blood tests to confirm that fact. Gardai formally launched an investigation into the incident after receiving a complaint.

    They spoke with Mr Prendeville and all the passengers seated near him at the time.

    Opinionated

    Those contacted as part of the garda probe were informed yesterday that no further action would be taken.

    Mr Prendeville has declined all comment on the matter after his initial statements in the wake of the controversy erupting.

    His show -- the most listened to radio programme outside Dublin -- has been hosted over recent months by PJ Coogan, a news reporter with 96 FM.

    Industry experts acknowledged that his return to air will shatter the show's existing audience figures -- 100,000-plus -- and will also likely deliver the station's biggest ever on-line listenership.

    But one station source admitted that there is concern over the future format of the show given the nature of the controversy and the broadcaster's highly opinionated style of presentation.

    The broadcaster -- who earns €150,000-plus per annum from 96 FM -- also admitted he felt suicidal in the wake of the coverage of the incident.

    Im surprised that the UK authorities have not taken this issue up.

    They usually take this stuff very serious and would have him sex offenders list if proven.

    Good on you Gearld Keane Not sure how much it helps in his clients job prospects. As now it will be preceived that he was not man enough to own up to his conduct take his punishment

    He's probably overcum with joy at the moment, but all it will take is for the aggrieved parties to now formally complain to the UK authorities, and they'll surely take it hand.

    Typical Irish stroke politics :rolleyes: When I first heard this I thought that although the DPP never prosecute any establishment figures like rogue politicians bankers or solicitors this was such a public and irrefutable set of circumstances that they would have to make an example of him.Silly me.Jurisdictional issues apparently.

    After four months the authorities here decide they are unable to pursue a **** observed by a number of people including a journalist and where the accused has essentially publicly confessed to the incident (although he claims that a mixture of medicine and alcohol affected his behaviour). What hope for the prospects of a prosecution in the case of Anglo?

    Funny how there is always some technicality to get certain connected people off the hook.The lack of serious attempts to prosecute or even be seen to attempt to prosecute powerful people in Irish society is facilitating a culture of impunity among them leading to disastrous results for the rest of us.

    Radio presenter Neil Prendeville is not to be prosecuted for committing a lewd act on an Aer Lingus flight, because of a jurisdictional technicality.
    The Cork 96FM presenter exposed himself and masturbated in public view of two Aer Lingus air hostesses and a female passenger, Irish Examiner journalist Niamh Hennessy, as the aircraft taxied to the runway at Heathrow airport en route to Cork last October.
    Ms Hennessy and the crew members subsequently made statements to gardaí, who sent a file to the Director of Public Prosecutions after completing their investigations.
    While the DPP declined to give a reason for not prosecuting Mr Prendeville — who apologised for the incident of which he says he has no memory due to a combination of drink and painkillers — the female witnesses were told it was due to a jurisdictional technicality. For certain offences — such as jeopardising the safety of the aircraft, passengers, property and good order or discipline on board — jurisdiction is defined at the moment the door of the aircraft is closed. For others — such as causing offence to any person on board — jurisdiction is determined at the moment power is applied for take-off.
    Aviation law expert Richard Martin said that as the incident occurred while the aircraft was taxiing to the runway, prior to commencing take-off, Mr Prendeville would have been subject to British, not Irish law, in relation to committing an act likely to cause offence.
    Yesterday, Ms Hennessy, who was seated next to Mr Prendeville on the flight, spoke of her upset at the decision not to prosecute.
    "I am horrified and dismayed that Mr Prendeville is not to be prosecuted for his appalling and totally unacceptable actions. This incident has caused me much hurt and I can only wonder what kind of message this gives out to people who may find themselves in a similar situation in the future."
    She said what Mr Prendeville did was wrong. "His actions were vile. There is something very wrong with the justice system if he will pay no price for what he has done. It begs the question should the gardaí now hand the file over to the British authorities," she said. Ms Hennessy said she will be making no further comment on the matter.
    Neither Mr Prendeville nor his solicitor Gerald Kean could be contacted for comment last night and it is unclear when or if the presenter will be back on air as 96FM chief executive Kieran McGeary said he had no comment to make.
    Once details of the incident became public last November, Mr Prendeville made an apology on radio. He has been on leave from his Cork’s 96FM flagship daily morning show since then.
    "I’m not going to be putting up any sort of defence. I hold my hand up and say: ‘If this is what happened, I take responsibility’," he said at the time. He said he would not challenge any prosecution that might result from the Garda investigation.
    He also left a message on Ms Hennessy’s voicemail after the incident in which he said: "I just wanted to apologise to you for any offence that I might have caused you." He said he had no recollection of the incident and when he was told about it he was "shocked and horrified".
    "I have no recollection whatsoever. I’m in shock, you know, I really am. I took some Nurofen Plus alright, I know that, for my neck. And as you know, with me anyway there was pints and wine and stuff and Jesus I don’t know where I’d begin to make it up to you," he said on the voicemail.

    I'd be amazed if that Knobhead returns to the airwaves? Owners must think there are 100,000 knobheads willing to listen to that Knobhead.
