    If this is the case, then how come the new law being proposed makes specific provisions for not have to retreat in your own home. I was watching the discussion on RTE and they specifically sighted this as one of the main changes over existing law.

    Because, as I've already said, the right to self defence comes from the common law. This is a move to put the right in statute & therefore making it easier for any cases involving self defence to be dealt with by the courts.
