iPhone misuse not cover under warranty

I recently [water] damaged my iPhone and I sent it back to Apple with the following response:

Your IPHONE 3G has been inspected by Apple technicians, who have determined that it has been subjected to accidental damage or misuse, which is not covered by the warranty or an Apple service contract. Therefore your original product is being returned to you unrepaired.

The iPhone is not unlocked and I am under contract with O2 and I have insurance. Does anyone know what I can do to get a new phone?

If i claim on the insurance, will I have to sign a new 18-month contract? I'd love a 3GS, but there doesn't seem to be any stock anywhere.

Claim it on insuarance will cost €30 admin to replace and you wont have to sign any contracts :) might take a while mine took 6 weeks but was over the xmas period

so you're certain water damage is covered under the insurance?

The official Apple email doesn't state anything about water damage... so I presume O2 can't prove it to be water damage anyway.

    Thanks for your input.

They can just look at the indicator on the top to tell if its water damaged.. prob easier to say you lost it

^^ this man speaks the truth ^^

Apple usually ask you if the water indicators are turned pink before collecting a phone for repair. If they won't fix it you can be sure insurance won't cover it either.

I hear what you guys are saying.

So i just go into the shop and say I lost my iPhone? it's as simple as that? won't they ask any questions?

If you state that it was stolen, they'll probably ask for a stolen report from the Gardai. If that's the case then you'll have to go to your local station and fill out the relevant form and lie to them stating that it was stolen. If you do go down that road make sure you have your story straight first
