In episode 3-12, "Par Avion", after Kate has scaled the perimeter she goes over to Bakunin and turns him over. The shot changes, and as we see Locke coming up behind her, the "dead" man is in the foreground and is clearly breathing. Also, as Kate flips him over, his throat moves, just a little, another indication that he's not dead.

Maybe it wasnt a mistake!!!
