Mistaking the rogue for the real thing is called "being duped".:D

To the best of my knowledge, Phishing is what happens when someone does it by email, pretending to be from a bank the user might be a member of or somesuch

The dodgy website would certainly be guilty of passing off

(yes, "passing off" is a legal term, bite me)

If they're guilty of soliciting funds via a dodgy website pretending to be someone else they'd be guilty of straightforward fraud as well.
