    In fairness, I agree with the judge about the Saturday only sittings of the DAP. It’s been years now, I’m sure that they could manage to get some cover for a day to do it mid week rather than stringing this out even longer.
    I actually bristled reading that Indo article. Martina claiming her conduct was calling out injustice when their goal is to undermine the court and garner publicity. The last thing that they are interested in is justice or fair procedure. They want it all their way and don’t care what damage that they have to do to get there.

    Was there another court case today? And today's outcome is the judge telling mammy Burke and sister Burke about contempt of court.

    Would the judge be referring to criminal contempt of court? Would that have to go to the DPP for the DPP to decide on the matter. Who would prepare the file for the DPP? Wasn't there something like that a few months ago but someone somewhere decided no contempt of court proceedings at that time.

    To be honest, the hunting of contempt of court a few months ago was a warning to the Burkes I reckon. The situation was so serious and they should have backed off and left the courts alone for their protests but they have consistently turned up and made a mockery of the courts and the legal system.

    I am just so so so sick of the whole entire lot of them. This sh1t was dragged out for so many years. They keep rattling the same old broken record.

    it’s in Wednesday apparently.
    presumably it’s from the court case last week. They are incapable of behaving themselves when things aren’t going exactly as they think they should.

    They have no respect for the system and have no right to be annoyed when it once again goes badly for them

    As in a case on Wednesday for mammy Burke and sister Burke for contempt of court? For real?

    Are we possibly going to see them in prison by the end of the week?

    That would be so so so so so good. You said it yourself. They have no respect for the system. This was hinted at months ago and that should have been a warning to them to back off from the courts with their bull.

    However, another quote from the independent above, makes my posts on the legal team and perjury very prescient, and probably is why Rosemary Mallon would/could not issue a denial.

    Enoch Burke had made the perjury allegation against Seán Ó Longáin, who was chairman of the DAP. Mr Ó Longáin has since resigned and a new DAP is to be constituted.

    Mr Justice Cregan said he would deal with the issue on Wednesday, which had already been set aside for a costs hearing in the litigation between the school and Mr Burke."

    Bear in mind that it would have been Mason Hayes Curran who probably dictated this affidavit, and Mallon who introduced it in court.

    And in general the Judge would just ignore where a lay litigant accused the opposing legal team of their habitual shenanigans, except now he can’t cos of Ammi & Martina.

    So you guys may laugh, but the Burkes are not fully wrong in this part alone- and it’s a failure of the legal system clique that they had to resort to this - they did not have much choice. It would have been swept under the carpet - because our legal system is fundamentally corrupt and biased against lay litigants.

    I’m conflicted - on this perjury part alone - who is worse the Burkes or the legal system? And I say the legal system.

    It will be interesting to see what the Judge says of the perjury part on Wednesday. Though nothing will ever come of it because the biased legal team in the DPP, or the Judge who deals with it eventually will quash it - in breach of his oath of office to impartiality.

    No, it wont be interesting. It will be yet another uneventful chapter in this neverending cycle of bullshit that the overwhelming majority of the public couldn't care less about anymore.

    In fairness, I agree with the judge about the Saturday only sittings of the DAP. It’s been years now, I’m sure that they could manage to get some cover for a day to do it mid week rather than stringing this out even longer.

    The DAP only meeting on a Saturday is not the thing delaying the process. It's the Judge you agree with giving countless nonsense injunctions.

    Because of his last couple there is now no DAP. Also the Judge ordered the court reconvene in a week, Burke requested 2 weeks, it was granted.

    Maybe the Judge needs to start sitting Saturdays and stop pandering to this absolute creep and not blaming volunteers who have to give up their time at weekends to constantly deal with a mess he is partly to blame for.

    In the interests of honest debate is it not time for you to drop the pretence that you are not on the side of the Burkes?

    No, because among other things he does not respect the law. (Neither does the legal system.)

    However, he/them are fully entitled to due process and the fair rule of law, and that must be done.

    Advocating otherwise is descending to their level; can't fight injustice with injustice, and morally can't fight hate with hate.

    To suggest that the legal system doesn't respect the law and is descending to their level is talking out of both sides of your mouth. The legal system has been extremely tolerant of a family that has no respect for any law that doesn't favour them. Your faux concern for due process isnt fooling me.

    Well you've showed your colours. A fait trial and a fair hanging.

    Clean hands applies to when he seeks an injunction where he is already in contempt.

    This is the schools case to fire him, and he like YOU and every other citizen is entitled to due process and the fair rule of law.

    I hope you can see this.

    Like you I've been following this worrying case since the start.

    However when it concludes and is consigned to history I will be happy.

    The school have fired him.

    He is injuncting his own appeal.

    The only person delaying due process is Burke.

    The contempt rulings, which are law court injunctions, applies to the occasions when he ignores the court orders to stay away from WHS.

    They do not apply to or prevent him attending the employment appeal process he is using to enable a return to his former job at WHS while also objecting to those members of the Appeals Panel he alleges are biased against him. The only person creating the roadblock he is facing is himself. I doubt if you are unaware of that set of facts.

    Talking about due process, fair trials and fair hangings when he has not provided the same right for anyone who offers to sit on the employment panel to hear his case against WHS is a tad unfair, if not an act of duplicity.

    He is fully entitled to use the law and any legal methods to impede him being finally fired

    Injunctions etc are fully legal, and in this case justified as the panel has resigned.

    Due process etc. allows him to fight his case as hard as he likes as long as it is legal.

    The real cause of the delay is the schools legal team - it is their case and their responsibity to ensure it proceeds even if he understandably drags his heels. The courts would have been happy to dispatch Enoch quickly, IF the school presented any sort of reasonable case.

    And, the perjury issue on their side is obviously why they were stuck, and why the appeal is taken so long - but that is not Enochs fault, and he will exploit it as much as he legally can.

    The law is the law whether you like it or not, so can't just support it when jailing him (rightfully).

    You don't have to like or support Enoch, or anybody else going to court, be they good or bad, murderers, rapists, or child seeking fair compensation for botched life limiting operation, to fully expect and deserve fair trial and due process.

    I'd better clarify before some people have a coniption...I do NOT support Enoch's reported behaviour at the school, before or after he was fired, especially since I understand the child was not even in his class ..but still believe he's entitled to due process....

    But he has been legally fired. He is holding up his own appeal against his dismissal.

    He's being paid so not fully fired, or at least not by the department.

    He was legally objecting to members of the panel, the key word being legally.
