The judge did not row back - quote from the Irish Times "

The judge was satisfied there were no errors in his judgment including his use of the words “baleful” about him and “malign”. He also rejected Mr Burke’s complaint about the use of the word “roaming” and “stalking” around the school.

"Is he following the school back to it's house? Is he officially charged with stalking the school building itself?" - Some poster here, probably

It was on the news there. Enough tried to delay the work appeals but a court denied this and it should be going ahead tomorrow. Finally there I'll be some progress made in this mess.

His behaviour since being suspended - the man is utterly delusional with mental health issues. It's very worrying how he kept shouting and misrepresenting the same broken record. He really shouldn't be allowed near children. If I was a parent with a child there in that school, I would be very concerned if he was reinstated in his old job.

I would say there isn't a hope he would be reinstated. Even in the unlikely event, the appeal found he was wrongfully dismissed / suspended, it would be almost certain he would be compensated rather than reinstated. In such an unlikely event, any compensation should go to the school and/or courts to offset his existing fines.

Does anyone know if tomorrow is the final step? If he is dismissed tomorrow can appeal to the WRC or Labour court?

  • Moderators, Science, Health & Environment Moderators Posts: 18,602 Mod ✭✭✭✭CatFromHue

I would have thought he could appeal to the WRC but his justification for going to the school won't be there if he loses the appeal tomorrow. He will be officially fired and he won't be getting paid.

Lol anyone know if the appeal is televised?

Also in one of the judgements from a judge he said that if the dismissal is upheal front the work appeal, he will let Enoch go free from prison because he will presume that with such a final route as a dismissal, he won't have a need to turn up at the school any more.

EB is such a pig headed man and so ignorant and arrogant he likely will keept turning up. So far the legal stuff with him has been civil but surely with a formal sacking if he keeps turning up, would that not turn the matter into criminal behaviour?

The whole thing is a mess. EB and his family are an awful dose. They are completely unable to be reasoned with.

So absolutely no point whatsoever in appealing.

  • Registered Users, Registered Users 2, Paid Member Posts: 16,107 ✭✭✭✭Arghus

Of course he'll keep turning up. He hasn't accepted being suspended, so he's not going to accept being fired!

Whatever the reason the gardai have for not intervening goes out the window if Enoch isn't an employee and is trespassing.

  • Registered Users, Registered Users 2 Posts: 5,238 ✭✭✭FishOnABike

There's a process that needs to be followed.

Enoch is largely responsible for the delay in hearing the appeal and even now tried to further delay his appeal. His legal filibustering has come to an end and the appeal will be heard tomorrow.

You cannot reason someone out of a position they did not reason themselves into. Enoch is living proof of this adage.

So after tomorrow, they can go after him for criminal trespass as he absolutely doesn't work there and as such has no business there.

Why the fk haven't they already done this to his relations who dont work there ever and have trespassed with him all this time if its possible to fk them into jail too.

Alas I cant see this sh1te ending

Excerpt from The Journal.ie report on todays court case: Quote: A judge said this week that Burke could be released from prison any time he purges his contempt, or when the DAP decides on whether he was fairly or unfairly dismissed by Wilson’s Hospital School.

If the panel decides against him after it meets tomorrow, Burke’s dismissal for gross misconduct will be confirmed. Unquote…

This means he wont have a legal leg to stand on to appear at WHS claiming he is turning up for work there as a teacher.

I do expect him and/or his family to continue with their "protest" actions on our Island regardless as they have an "interest" in doing so for their own benefit at this stage.

Hopefully, if they try to go to the Supreme Court by way of appeal, they will be told the case he/they presented does [in the opinion of the SC] not reach the standard required for an appeal to be heard by it.

I don't know whether the SC could also decide that the Burke family are presenting suites to the courts for vexatious purposes alone and act against the family on that basis to stop the family wasting judicial time.

And how exactly do you know what the principal said?

To thine own self be true

Given the disruption and chaos that the Burke family cause every time in court, I can only imagine the way Enoch approached the principal and the scene he caused.

You can't behave like that in any work place but especially in a school and where there are parents and students present.

To thine own self be true

appeal on today for Burke, if the venue is known expect the family to be there, shouting and roaring, following the members around

Was thinking about this yesterday, the board should have put out a bogus location at a bogus time to avoid these gobshites.

Nothing much to report on until the hearing is complete and a decision made.

  • Registered Users, Registered Users 2 Posts: 277 ✭✭goldsparkle

Is this the work appeals? Surely it's a private matter and wouldn't really be reported in any news. It's not really a public matter. I think there is a high court hearing on Wednesday but I don't know. That's according to a solicitor on tiktok reading about one of the latest updates. So it's possible we won't hear anything about the school dismissal appeal until Wednesday because it could be referred to in court. The Brakes will no doubt 'report' on this appeal and outcome themselves but they tell lies so you wouldn't really know what's the truth from them. We might be able to garnish a little bit of reality and truth from a video they may put up online but it will be filled with lies as well.

I agree. I'd say he was a terrible teacher. And I would never let that man be alone with children ever again. He is clearly unhinged.

What are they doing in the Hyacinth house?

  • Registered Users, Registered Users 2, Paid Member Posts: 37,417 ✭✭✭✭Penn

Yeah that's true too, it may not usually be information released publicly. Then again, given the on-going legal cases and how publicised the entire case has been (and which the Burkes have not shyed away from publicising themselves), it's probably justifiable that they publicly reveal their decision, if for no other reason than to get the truth out before the Burkes have a chance to put their own spin on it.

Unfortunately for the board they have to inform Enoch of the details as he would be entitled to attend.

by all accounts an excellent teacher with excellent exam results to match- it’s such a pity schools wouldn’t just focus on actual education rather than radical social interference- that’s what the vast majority of parents want. The principal started all this rubbish up as she knew full well Enoch wasn’t on board with made up pro nouns and all that utter rubbish.
As for the armchair mental illness diagnosis - what actual evidence have you to say he’s “unhinged”? That’s a very serious thing to say about someone you presumably don’t know personally or professionally

  • Registered Users, Registered Users 2 Posts: 20,483 ✭✭✭✭road_high

proper order- it’s his job and responsibility they’re discussing- they might not like it, but he’s perfectly entitled to be there

Any evidence to support any of this?

    1. Exam results above the norm.
    2. Whatever you are trying to say about what the majority of parents want.
    3. Principal planned the whole thing.
