Penalty Points and Driving Test

    Hi all,
    I’m currently on a learner permit in Ireland and have just received offence letters totalling 7 penalty points. The deadline to pay the fines is at the end of May, but I’ve already booked my driving test for mid-May.

    I understand that 7 points can lead to a 6-month disqualification for learner drivers. My questions are:

    • Am I still eligible to take the test before the points are officially applied?
    • Does the disqualification start only after paying the fines, or does it affect me immediately?
    • Also, would it make any difference if the disqualification happens while I’m still on a learner permit versus after getting a full licence? Is one situation better than the other in terms of long-term impact?

    Would really appreciate any advice or shared experiences—thanks in advance!

    I believe paying the fine is an admission of guilt so I imagine you wouldn’t be disqualified until after you are ‘found guilty’. So I would probably just do your driving test and pay the fines after your NDLS appointment for the full license.

    And slow down. Your insurance will be much higher with the points too.

    yes; please stop driving. you've accumulated 7 more points even before you've sat your test, than i have in 25 years of driving.

    Think the points are automatic 28 days after the notice. 7 points on a provisional or first 2 years of a full is a disqualification & you'll have those points for 3 years so even if you get 1 point in the 2 years after passing your test you'll be off the road again. Maybe do the test & hopefully pass. Sell your car & walk for 2 years because with your track record so far, another disqualification isn't far away.

    What happened to innocent until proven guilty? If you don’t pay the fine it escalates to court where you will be found either guilty or innocent?

    Already guilty of the offences when he/she got the 28 day notice of points being attached. Don't know - not paying the fine prob means a court date & possibly a few more points? Innocent until guilty is only for murder cases :)

    OP maybe review your attitude to driving rather than asking on internet how to bend the rules and cheat the system?

    Do you think you should be given full license and let drive around and break the rules again.

    This is what we meet on the roads every day.

    Driving standards are in a hole and someone with 7 points is still to take their test.

    I'll go out on a limb here and say someone in that situation shouldn't be able to drive/take a driving test until a certain time has passed and a bit of respect for the rules of the road are beaten into their skull.

    Well, the OP hasn't actually got the points yet.

    There does need to be some time for letters to be sent, fines to be processed, vehicle owners to nominate a driver, appeals to be made, etc. There really is no way around that time period with an automated speed camera system, and the OP just so happens to be in the lucky position that they can push out paying the fine and accepting the points until after their test.

    But at least that time is a fixed period for every offender.

    My issue with the system is that the RSA are hopelessly slow in applying points after a fine has been paid. It can take months for points to be applied, which could mean another insurance cycle for someone who has paid immediately, or alternatively someone else not being disqualified when they should be.

    IIf Only there was some way of having the points go onto the licence automatically.

    But nothing will ever be done properly in this country to control the morons who bring no thought or respect for rules with them when they get behind the wheel of a car.

    Points come much more quickly now. I got a points letter a couple of weeks after the offence. Was doing 64 in a new 50 zone. Very annoying. Even my speed limit recognition told me it was an 80 zone up to a few weeks after it had changed.

    But it takes some talent to rack up 7 points before even taking the test. Assume some of them for driving without an experienced driver. I think that's 2 points. So probably 5 in one go - speeding and driving alone.

    That's nuts. Do you mind asking where you live @Info_Seeker ?

    I met a young fella a while ago that was caught driving under the influence of hash three times. I asked him how did that happen considering I haven't been stopped by a guard in the last five years. He said it's down to where you live, he lives in a rough Dublin suburb that's heavily policed.

    You could get them all in one go. Any number of possible 3 pointers - speeding, no NCT disc, using mobile phone etc.

    The OP could have been stopped for using their phone (3 points), unaccompanied (2 points) and no L plate (2 points).

    So the most you could get in one stop is 3

    don’t worry; if they can’t drive they won’t pass. But it doesn’t matter because they’ll drive anyway.

    Just like it doesn’t matter if some people are banned, they drive anyway. Sure wasn’t it only in the paper today a driver was caught in Kildare around Kilcock carrying a fake licence, no tax, insurance and detected cannabis after a drug test.

    That’s what you’re sharing the roads with.

    You'll be walking for six months and you are possibly obliged to notify your insurance when you get the points.

    Good luck with the cost of your insurance with a six month driving disqualification on your record. If you fail to notify your insurer you might invalidate your insurance cover.

    Not to mention the scores of drivers who literally can't take their eyes off their phones while they drive around on all roads. I saw some plonker beside me on the motorway yesterday evening on my way back from reporting an accident I was in a few days ago. Was he on his phone? Of course….watching Netflix doing about 100km/h!!! Maybe it was TikTok, but it was video anyway.

    I don't think so. Having read the 2024 act (and not sure if that section has been commenced yet) it seems only two will be applied - 5 points. If it hasn't been commenced, then you'll just get 3 points.

    3A) Where a person, whether on the same occasion or not, makes 3 or more payments referred to in subsection (1) in respect of alleged penalty point offences committed on the same occasion, penalty points in respect of 2 only of the alleged offences, determined, where appropriate, in accordance with subsection (4A), shall together be endorsed on the entry relating to the person.
