Annual leave seasonal staff

    Hi I am starting a 6 month contract for seasonal work soon. Over this time I will accrue 10 days annual leave and 5 public holidays. Can the employer refuse to allow me take any of these days off and instead insist on paying me in lieu at the end of the 6 months?

    Payment in lieu for holidays is banned under the EU working time directive.

    While this is correct, there is one exception, and that is any untaken leave at the end of employment needs to be paid.

    Yes, annual leave is taken at a mutually agreed time.

    It would be unusual for an employer to be totally inflexible: most would allow seasonal staff to have occasional days of leave. But most would not want you being off for a week or two at a time.

    Also remember that you will not earn your final 1.5 (ish) days of leave until you complete working month six. Many employers don't like seasonal staff taking anticipated leave, because they don't want to deal with the hissy fits that people throw if they leave the job early and have to "pay back" annual leave taken but not yet earned.

    thank you for the replies. I can understand them not wanting seasonal staff to take a week or two at a time.
    My thinking was if I’m off Monday & Tuesday for eg that I might be able to take 2/3 days annual leave once or twice during the 6 months to give me 4/5 days off together out of 7 that week.
    Over the 6 months I’d only be using 5/6 of the 15 days accursed from annual leave and public holidays.

    Employer would be happy with you taking 5/6 days at a mutually agreed time

    Thank you. That’s what I was thinking, but the manager in the local branch has emphasised a number of times they won’t be approving any leave for seasonal staff and we will be paid for it at the end of the contract instead!

    I will try get written approval of my leave from the hiring manager before I begin.
